HomeMy WebLinkAboutPC RES 1207 $ 4 5 6 ? 9 10 11 14 15 20 21 24 25 27 50 RESOLUTION NO. 1207 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN GRANTING A CONDITIONAL USE PERMIT. ON APPLICATION NO. UP-71-359 OF LUMINART-DIVISION OF AD-ART, INC. ON BEHALF OF GREINKE PETROLEUM CORP. The Planning Commission of the City of Tustin does here by resolve as follows: 1. The Planning Commission finds and determines as as follows: a) That a proper application No. UP-71-359 was filed on behalf of Greinke Petroleum Corp. for a Con- ditional Use Permit to allow a ll6-square foot roof sign on the~ property described in Exhibit "A" at- tached hereto and incorporated herein by this reference as though set forth herein'in full. b) That a public hearing was duly called, noticed and held on said application; c) That establishment, maintenance aid operation of th~ use applied'for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1) The proposed sign will be the.only sign of consequence located on the property; 2) It does not exceed the height of the existing structure; 3) Is aesthetically designed; and, 4) Conforms to the Sign Ordinance in all respects. d) That the establishment, maintenance and operation of the use applied for will not be injurious or~ detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of'Tustin, and Should be granted. e) Proposed deVelopment shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Fire Chief, and street improvement requirements as administered by the City Engineer. 1 2 4 5 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 f) Final development plans shall require the review and approval of the Development Preview Commission. 2. The Planning Commission hereby grants a Conditiona~ Use Permit, as applied for, to allow a ll6-square ~foot roof sign in lieu of a free standing sign.
