A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN GRANTING A VARIANCE ON APPLICATION
NO. V-70-277 OF UNION OIL COMPANY OF CALIFORNIA
The Planning Commission of the City of Tustin does
hereby resolve as follows:
1. The Planning Commission finds and determines
follows:
a) That a proper application for Variance .70-277
was filed on behalf of UNION OIL COMPANY OF
CALIFORNIA for a variance to permit the
erection of a 90-foot high, 628-square foot
display area free-standing sign exceeding the
maximum permitted height and display area for
.a given service stati'on site on the property
described in Exhibit "A" attached hereto and
iincorporated herein by this reference, as
though set forth herein in full;
b) That a public hearing was duiy called,~ noticed
and held on ~aid application;
c) That because of special circumstances appli-
cable to the subject property, relative to
size, shape, topography, location or sur-
roundings, a strict application of the Zoning
Ordinance is found to deprive the subject
property"of privileges enjoyed by other
properties in the vicinity and under ident al
zone classification, evidenced by the foll in¢
findings:
1. That subject serwice station site is
located 235 feet from the Santa Ana
Freeway right-of-way.
2. That other service stations in the im-
mediate area have been granted freeway-
oriented, free-standing signs similar
in height and area.
d) That the granting of a variance as herein
'' provided will not constitute a grant of
special privilege inconsistent with the
limitations upon other properties. in the
vicinity and district in which the subject
property is situated;

e) That the granting of the variance as herein
provided will not be contrary to the intent
of the Zoning Ordinance or the public safety,
health and welfare, and said variance should
be granted;
Proposed development shall be in accordance
with the development policies adopted by the
City Council, Uniform Building Codes as
administered by the Building Official, Fire
Code as administered by the Fire Chief, and
streetimprovement requirements as administered
by the City Engineer; and,
g) Final ~.development plans shall require the
review and approval o~ the Development Preview
Commission.
2. The Planning Commission hereby grants a variance
to permit a maximum 60-foot high, 245-square foot, or less, display
area, free-standing sign, on a single column, on subject site
subject to the following conditions:
.1. That subject sign be located in the north-
westerly corner of the subject service
station .site, adjacent to the Nisson Road
frontage;
2. That the existing 35-foot high, revolving,
free-standing sign presently located at the
northeast corner of the site be structurally
reduced in height to less than 20 feet,
overall, with a minimum ground clearance of
10 feet; and, ·
3. That this existing sign be mechanically
adjusted so that it does not revolve.

ornia as shown on a map recorded'in Book 5, Page 7 of Miscellaneous Records
in the office of the County Recorder of Los Angeles County, California,
described as follows:
Beginning at the most Sotherly corner of the land described in the deed
to the State of California, recorded on June 29, 1954 in Book 2759, Page
48 of Official Records in the office of the County Recorder of said Orange
County, said corner being in the Northwesterly line of Red Hill Avenue,
66.00 feet wide; thence along said Northwesterly line South 39° 55' 58"
West 132.00 feet; thence at right angles to said Northwesterly line North
50° 04' 02" West 167.00 feet; thence parallel with said Northwesterly line
North 39" 55' 58" East 173.00 feet, more or less, to ~he Southwesterly
line of said land to the State of California, said Southwesterly line
being a curve concave Northeasterly and having a radius of 528.00 feet;
thence Southeasterly along said Southwesterly line an arc distance of
147.00 feet, more or less, to the end thereof; thence continuing.along
said Southwesterly line South 04° 28' 22" East 20.86 feet to the point of
beginning.
