RESOLUTION NO. 1183
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, GRANTING A VARIANCE
ON APPLICATION NO. V 70-274 OF LUCKY STORES, INC

The Planning Commission of the City of Tustin, Cali-
5 fornia, does hereby resolve as follows:

1. The Planning Commission finds and determines:
a) That a proper application (No. V. 70-274) was
filed ~by LUCKY STORES, INC., for authority tO
permit a 50 foot high, 520 square feet, free-
standing sign exceeding the maximum code per-
mitted height and display area, and two wall
signs for one business establishment, on the
propecty described in Exhibit "A" attached
hereto and incorporated herein by this refer-
ence.
b) That a public hearing was duly called, noticed
and held on said application.

c) That the proposed 50 foot height and 520 squar~
feet display area are not deemed necessary for
adequate advertising purposes, and;

d) That the proposed design specifications would
create an adverse aesthetic effect on the sur-
rounding area, and;

e) That the proposed height and display area could
establish a precedent for other businesses, in
this area, and;

f) That the two requested wall signs ("Liquor" and
"Lucky 'Discount Center")~proposed to be attachek/
to the ~.northwest wall of the main store struc- '
ture are deemed appropriate due to the overall
comparative size of the structure's wall and
the proposed sign, and;
g) That said two signs would not prove to be del
mental to the general area.

2. The Planning Commission hereby grants the variance
as pertains only to that portion which authorizes two wall signs
for one business establishment, subject to the review and approval
?
of all signing for the shopping center by the Development Preview
Commission.
30 3. The Planning Commission hereby denies the variance
31 as pertains to authorization~ for any signing that would exceed
32 the height and size criteria as specified by Ordinance No. 438
(Sign Ordinance). ~
PASSED AND ADOPTED at a regular meeting of the Planninl
Commission of the City of Tustin, Califoraia, held on the 28th day
of SEPTEMBER 1970.
