A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, GRANTING A VARIANCE_
ON APPLICATION NO. V. 70-273 OF SUNSET BUILDERS
ON BEHALF OF EDMUND GAULDEN AND JAMES A. PADOVA.
The Planning Commission of the City of Tustin, Califo
does hereby resolve as follows: .
1. Planning Commission finds and determines:

That a proper application (No. V. 70-273) was
filed by SUNSET BUILDERS on behalf of EDMUND
GAULDEN and JAMES A. PADOVA, for authority to
establish an office ~trdcture with less than the
minimum required side and rear yard structural
setbacks on the property described in Exhibit
"A" attached hereto and incorporated herein by
this reference. I
That a public hearing was duly called, noticed
and held on said application, i

That as a result of the size, shape, and location
of subject property, development difficulties
exist in relationship to other professionally
developed properties in the immediate vicinity,
and;
d)
That the requested zero foot setback for the
structure adjacent to the rear property line wuuld
not be detrimental to the property adjacent and
to the north as a result of that property being
utilized as a public school playground and park-
ing lot, and;
e)
That the requested zero foot side yard setback
along the west property line of subject property!
would not be detrimental to the adjacent property
to the west where the proposed main structure ~
would be adjacent to the private drive and ~
private parking area of this western property |
(the approximate western rear 64 feet of subJectl
property), and;

f) That.this proposed zero foot side yard setback
could prove to be visually detrimental where the
proposed main structure would be opposite the
existing two-story structure with windows locate
to the west (the approximate western front 40 fe~t
of subject property),
g) That the applicant must have approval of the C
Engineer for location of access drives from p[...

The Planning Commission hereby grants the variance,
as applied for, subject to the following conditions:

a) Compliance with the requirements of the Fire
Code as stipulated by the Fire Chief.
b) Installation of sidewalk and street trees on
Irvlne Boulevard, annexation to the Tustin
Lighting District with the installation of one
street light and underground conduit on the "B"
Street frontage, and a maximum height of 3 feet
within 10 feet of the "B" Street property line
on any wall constructed along the north property
line if a drive access to "B" Street is provided
in that area.
c) A minimum 5 foot structural setback being main-
tained along the front 40 feet of the west pro-
perty lime, with saidar, ea to be adequately land
scaped. :
d) Review and approval of the final plans of devel-
opment by the Development Preview Commission.
PASSED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Tustin, California, held on the 28th day
of September, 1970

Commencing at a point on the centerline of Prospect Avenue, distant thereon
Northerly 784..39 feet from the Southeast corner of the first tract allotted
to Teodoc~a ¥orba by decree in the partition of the Rancho Santiago de
Santa Ana, in the suit of Abel Stearns, and others, vs. Leonardo Cota, and
others, said Southeast corner being marked by a bolt at the centerline
intersec'tion of Prospect Avenue and First Street! thence South 89' 37' 54"
West, 1219.96 feet to a point in the West line of said tract allotted to
Teodocia Yorba, distant along said Westerly line North 0° 10' 30" West
781.34 feet from the Southwest corner of said tract, said point being the
Southwest corner of the land described in the deed to Tustin School District
of Orange County, recorded November 10, 1959, in Book 1966, page 521, Official
'Records; thence North 0° 10' 30" West along said West line, 163.02 feet to
the center]the of the 60-foot easement for street purposes described in the
deed to the County of Orange, recorded February 1, 1962, in Book 5995, page

boundary of the land described herein, and being on a curve concave South-

along the Easterly prolongation of the North line of said Tract 531t, North

149.89 feet to the centerline of said 60-foot easement conveyed to the County
of Orange, hereinbefore mentioned; thence along said centerline South 89~' 35'
13" West 62.39 feet to the beginning of a tangent curve therein concave
