U.P. 70-347 OF R.B. HORNE ON BEHALF OF G.L.A. DEVELOPMENT CO. ~SE PERMIT ON APPLICATION NO- ~- ~- 70-347 OF ~R.. ~, HORNE ON BEHAL~ O__F ~. ~. A- ~.EVELOPMENT CO. · The Planning commission of the City of Tustin, California , does hereby resolve as follows: 1. The Planning Commission finds and determines: a) That a proper application (No. U. P. 70-347) was filed bylR. B. HORNE ,on behalf of G. L. A. DE- VELOPMENT CO., for a Conditional Use Permit to permit the establishment of a take-out restauran~ with outdoor patio eating facilities on the pro- perty described in Exhibit A at{ached hereto and incorporated herein by this reference. b) That a public hearing was duly called, noticed and held on said application. c) That the establishment, maintenance and operation , of the use applied for will not, under the cir- , cumstances of the particular case, be detrimental to the health, safety, morals, comfort and genera!l welfare of the persons residing or working in thel neighborhood of the proposed use, and it will not be injurious., or detrimental tO the neighborhood or the general welfare of the City. 2, A Conditional Use Permit is hereby granted as applied for, for rezoning of subject property to the C-1 Retail Commercial District, subject to the following conditions: a) Adoption of the ordinance establishing C-1 zoning for subject parcel, b) ComplianCe with stipulated requirements of the City Engineer to include street improvements the Newport Avenue frontage; installation of street lighting and street trees; submission and approval of a parcel map; and, necessary arrange- ments witlh Santa Aha Valley Irrigation Company f relocation of irrigation facilities involved in street improvements. c) Compliance with the stipulated requirements of Fire Chief including a 10 lb..dry chemical extin- gui she r. d) Hours of Operation shall be limited to the between ~:00 a.m. and 11:00 p.m. · 4 5 6 ? 8 9 11 14 15 16 18 19 Z0 · -' ~4 ~5 ~6 Z? ~8 ~9 50 .51 ROURK~ ~ HOLBROOK A~ORN~Y8 AT ~W CROCKER-CITIZ~N~ BANK UUILDING I~ NORTH BROADWAY ~ANTA ANA, CALIF. e) Subject operations shall be conducted so as not t~ be a nuisance to adjacent residential properties and surrounding area by. the reason of noise, smoke, odor and litter, and in furtherance of this objective, commercial trash collection shall be i limited to the hours of operation specified he~.i f) Review and approval of Final Development Plan~ ~y the Development Preview Commission including lighting, walls, tree-screen landscaping, parking, and vehicular circulation design.
