P. 7Q-348 OF T---~ ARBORETUM, IN__~C., ON BEHA---LF~F LUMBERME---'-N_'-~ MERCANTILE COMPANY. The Planning Commission Of the City of Tustin, Califoz does hereby resolve as follows: 1. The Planning Commission finds and determines: a) That a proper application (No. U. P. 70-348) was filed by THE ARBORETUM, INC., on behalf of LUM- BERMEN'S MERCANTILE COMPANY for a Conditional Permit to permit establishment of an outdoor sale area on the property described in Exhibit A at- tached hereto. b) That a public hearing was duly Ca'lled, noticed and held on said application. c) That the establishment, maintenance and opez of the use applied for will not, under the cir- cumstances of the particular case, be detrimental to the health, safety, morals, comfort and. genera! welfare of the persons residing or working in the' neighborhood of the proposed use, and it will be injurious or detrimental to the neighborhO- ~ or the general welfare of the City. 2. A Conditional Use permit is hereby granted as applied for, subject tO the following conditions: a) ComplianCe with the stipulated requirements 'of th, Fire Chief to include a paved fire access road an turn around area; said driveway and fire access road to have a minimum vertical clearance of 14 f' hydrants to be provided as required; and, fire extinguishers. b) The location and intensity of any night lighting to be such as not' to constitute a hazard to. vehiCular traffic on the .Newport Freeway or the adjacent northbound off-ramp. c) Adequate screening or enclosure of all materials, other than plant materials, from view of the Newport Freeway or off-ramp. · d) The filing and recording of'necessary reciprc-al vehicular and pedestrian easement agreements. approved by the City Attorney, for the purpo: o~- providing vehicular and pedestrian access to and from Edinger Avenue over the A.
