A RESOLL~ZION OF TILE PLA~NNING COIdMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, GPJANTI~G A VA:{IAI.?CE
ON APPLICATION NO. V_. 70-271 OF EARL E.-
The Planning Commission of the City of Tus~n, california
does hereby resolve as follows:
The Planning Commission finds and determines:
a) That a proper application (No. V. 70-271) was
filed on behalf of EARL E. CLAYTON for a variance
to permit waiver of front and side yard structura~
setbacks on the property described in Exhibit A
attached hereto.
b) That a public hearing on said application was dui~
called, noticed and held.
c) That there are special circumstances applicable
to the propek-ty including the dedication of 13 feet
of parkway on Pacific Street as compared with the
usual standard of 8 feet, and the development of
the property under specific development standards;
the strict application of the Zoning Ordinance
would deprive subject property of privileges en-
joyed by other property owners in the vicinity
and under identical zoning classification, and;
d) That the proposed 15-foot structural setback on
Pacific street; proposed. 3-foot side yard setbacks;
minor alterations to other approved side yard
setbacks; and, the additional vehicular access
drive; would be compatible in the PC Districts wi~ah
other uses in the vicinity; and would have no
adverse effect upon adjoining properties and
would not be a grant of special privileges in-
consistent with the limitations upon other pro-
perties in the vicinity and zone, and should be
approved, subject to the following conditions.
2. The Planning Commission hereby grants a variance, as
applied for, subject to the following conditions: Development in'
accordance with the specific plans on file with this petition, with
final review and approval by the Development Preview Commission'
with said Commission authorized to make minor changes in interior
design and structural arrangement.
