V-70-269 OF SHELL OIL COMPANY ON BEHALF OF EDGAR E. PANKEY. The Planning Commission of the~City of T~stin, California, does hereby resolve as follows: 1. The Planning Commission finds and determines: · a) That a proper application (NO-V-70-269) was filed by SHELL OIL COMPANY on~ behalf of .EDGAR E. PANKEY for a Variance to permit a free-standing sign on the property described in Exhibit "A" attached hereto. b) That a public hearing was duly called, noticed and held on said application. c) That a public hearing has been duly advertised and held on V-70-269 for authority to erect a free-standing sign exceeding the maxim~ permitted height, display area, and number of signs on a given site on property located at the northwest corner of Red Hill Avenue and Laguna Road, and; d) That the proposed erection of the free-standing sign is compatible in a C-2 District with other freeway oriented uses, would have no adverse effect on the adjoining properties, and the total signing for this site in accordance with sign plans DP-70-100 as submitted by the applicant is compatible with the site and~use of the property. e) That there are special circumstances applicable to the subject property, including the prior dedication of property for street purposes, freeway orientation of the business wi~h proximity to .on and off-ramps, and less than 16' deviation from the distance requirements for permitted freeway signing authorized for other businesses within the area. 2. A Variance is hereby granted for a free-standing sign as applied for, subject to the conditions: that all signs shall be stationary, without rotation; that final review of all sign design, including price panels shall be subject to approval of the Development Preview Committee; that a sign permi% may be issued at the time a building permit is issued, but the sign shall not be constructed until building improvements have been completed, and said sign shall not be closer than fifteen.feet (15') from the Southwesterly property line. No. 1163 V-70-269 EXHIBIT "A" ATTACHMENT - LEGAL DESCRIPTION That portion of Lot 31 i~ Block 12 of Irvine's Subdivision, in the county of Orange, state of California, as per map recorded in book 1 page 88 of Miscel- ianeous Maps, in the office of the county recorder of said county, described as follows: Beginning at a point on the Southeasterly line of said lot, being on the center line of Red Hill Avenue, 66.00 feet wide, distant thereon North 39° 55' !8" East 425.58 feet from the intersection of said center line with the center line of that certain 60 foot right of way conveyed to the State of California by deed ~nd recorded November 24, 1914 in book 262 page 227 of Deeds; dated July 1, 1914, thence North 39° 55' East 135.00 feet; thence North 50° 05' 57" West 200.00 feet; thence South 39° 55' 18" West 175.16 feet to the northerly line of the land described in the deed to the State of California, recorded September 23, 1954 in book 2824 page 523 of Official Records; thence easterly along said northerly line to the point of beginning.
