RESOLUTION NO. 1159
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, GRANTING A CONDITIONAL
USE PERMIT ON APPLICATION NO. U.P. 70-341 OF
PALOS VERDES PENINSULA TENNIS CLUB, INC. ON BEHALF
OF RALPH SCHENCK.
The Planning Commission of the City of Tustln, Caiifor,~_a,
does hereby resolve as follows:
1. The Planning Con~.ission finds and determines:
a) That a proper application (No. U.P. 70-341) was
filed by PALOS VERDES PENINSULA TENNIS CLUB, iNC.
on behalf of P~ALPH SC].~NCK for a Conditional Use
Permit to permit a swim school, swi~ club and
athletic facility on the property described in
Exhibit A attached hereto.
b) That a public hearing was duly called, noticed
and held on said application.
c) That the proposed swim school and swim club is
compatible in the 100-C-!-10,000 district with
other properties, and existing uses would have
no adverse effect upon the adjoining properties.
16. 2. A Conditional Use Permit is hereby granted to perz

a) Conformance with the stipulated requirements of th(
Fire Code as determined by the Fire Chief.
b) Compliance with the requirements of the Orange
County Health Department.
c) Compliance with the requirements of the City
Engineer as stipulated in the report dated

d) Approval of development plans by the Development
Preview Committee.
e) That the revised plot plan filed showing sixteen
(16) parking spaces filed at the public hearing
be deemed a part of the approved application.

The pr'oposed development shou.ld not create any unusual problems
from the traffic standpoint. It should be noted, however, that
the development encompasses only the north 50 feet.of the 147.95
foot parcel shown as Parcel No. 2 on a Parcel Map recorded in July
of 1967. Current zoning for this area is 100-C1-10,000 indicating
that the minimum parcel frontage must be 100 feet; therefore, the
developers should be made aware that further division of Parcel 2
would not be appropriate under the current zoning.
Curb and street paving have been constructed in this area of Elizabeth
Way and the property is within the Tustin Street Lighting District.
No other street improvements or lighting exist at the present time.
The' recorded Parcel Map indicates a proposed half-street right-of-way
of 25 feet. This is not in accordance with the City Council's policy
concerning minimum street right-of-way within the City of Tustin and
adequate right-of-way is particularly important in a commercial area.
If this development is approved it is recommended that it be subject
to the following conditions:
1. Dedication of 30 feet of right-of-way from centerline for
the westerly half of Elizabeth Way.
2. Installation of sidewalk, approved street trees and the
closure of any unused curb depression or the installation
of concrete drive approaches.
3. Installation of one street light with underground conduit.

All that certain land situated in the State of California,
County of Orange, described as follows:
A portion of the northwest half of the northwest half of
the south quarter of Lot 331, Block 13, Irvine's Subdivision
as per map recorded in Book 1, page 88 of M.R.M., records
of Orange County, California.
