RESOLUTION NO. 1135
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, GRANTING A VARIANCE ON
APPLICATION NO. V. 69-264 OF CHARLES W. ERICKSON
The Planning Commission of the City of Tustin, California,
does hereby resolve as follows:
1. The Planning Commission finds and determines:
a) That a proper application (No. V. 69-264) was file~
on behalf of CHARLES W. ERICKSON for a variance
to permit non-uniform fencing on the property
described in Exhibit A attached hereto and incor-
porated herein by this reference.
b) That a public hearing was duly called, noticed
and held on said application.
c) That the adjustment applied for will not constitut
a grant of special privilege inconsistent with
the limitations upon other properties in the
vicinity and district in which the .property is
situated.
d) That special circumstances applicable to the sub-
ject property, including size, shape, topography,
location or surroundings, because of the strict
~application of the zoning ordinance, deprive sub-
ject property of privileges enjoyed by other
properties in the vicinity and under identical
zone classification.
2. A Variance is hereby granted, as applied for, to
permit construction of a block wall along the Southern boundaries
fronting residential properties and tri-stake~fence along'
boundaries fronting the railroad right-of-way subject to the
condition that walls be approVed by appropriate city departments
relative to soil retaining characteristics. °
PASSED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Tustin, California, held on the 12th
day of January, 1970.

Beginning at the West corner of said Lot 37; thence South
49° 19' 16" East along the Southwest line of said Lot 660.00
feet to the Northwest line of that certain 60°00 foot
easement as described in a deed to the Atchison, Topeka:
and Santa Fe Railway Company recorded August 29, 1914 in
Book 258, page 383 of Deeds of Orange County; thence North'
40o 43' 01" East along said Northwest line 1227.85 feet to
the Southwest line of the Santa Aha Freeway as described in
a deed to the State of California recorded October 17, 1957
in Book 4027, page 65 of Official Records of said County;
thence North 460 44' 37" West along said Southwest line 660.70
feet to the Northwest line of said Lot 37; thence South
40° 42' 53" West along said line 1257.56 feet to the point
of beginning..
RESERVING UNTO LESSO?.~ its successors and assigns the
Northwesterly 40°00 feet for road purposes.
SUBJECT TO easements, rights of way and other matters of
record ox apparent.
