The Planning Co,mission finds and determines: a) That a proper application (No. V.69-257) was fi!e~ by TRANS ROBLES CORPOP~%TiON for a variance to per- mit eave encroachment into required side-yard set- back on the property described in Exhibit A attached hereto. b) A public hearing was duly called, noticed and held on said application. c) That the adjustment applied for will not consti- tute a grant of special privilege inconsistent with the limitations upon other properties in t2ae vicinity and district in which the property is situated. d) ~nat special circumstances applicable to the ~:'" Ject property, including size, shape, topograp[:i location or surroundings, because of the strict application of the zoning ordinance, deprive sub- ject property of privileges enjoyed by other pro- perties in the vlcinity and under identical zone classification. e) That a variance should be granted. 2. Variances are hereby granted as applied for, subject to the following conditions: a) .That no variance shall be granted on any lot for which the o~.~ner or purchaser advises the CiUy, writing, within five working days after notice from the City, that the owner or purchaser does not want the variance granted. b) That eave gutters, down-spouts and water runoff and disposal facilities satisfactory to the Build- ~nscalled on two-story hc~ ing Official shall be" ~- ~ on lots for which a variance is granted. c) That all improvements shall be in ~ = ~-v the requirements of the Building Code of the C~v~ of Tustln.
