RESOLUTION NO. 1097
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, GRANTING A CONDITIONAL
USE PERMIT ON APPLICATION NO. U.P. 69-304 OF
ROBERT H. GRANT DEVELOPER, INC. ON BEHALF OF THE
IRVINE COMPANY.

The Planning Commission of the City of Tustin, California;
does hereby resolve as follows:' .~
1. The Planning Commission finds and determines:
a) That a proper application (No. U. P. 69-304) was
filed on behalf of ROBERT H. GRAI~T DEVELOPER, LNC.
on behalf of THE IRVINE COMPA/,~Y to permit the
continued use of a temporary construction material
storage yard and contractors office for a six
month period on the property described in Exhibit
A attached hereto.

b) That a public hearing was duly called, noticed
and held on said application.
c)
That the setablishment, maintenance and operation
o~ the use applied for will not, under the circu~r~-
stances of the particular case, be detrimental ~o
the health, safety, morals, comfort and general
welfare of the persons residing or working in the
neighborhood of the proposed use and it will not
be injurious or detrimental to the property and
improvements in the neighborhood or the general
welfare o~ the City.
d) That a Conditional Use Permit should be granted.
2. A Conditional Use Permit is hereby granted as applied
~or subject to the following conditions:
a) That the permit is granted for a six (6) month
period.
b) That the entire area utilized be fenced at all
times.
c)
That the 'yard be screened from view to the satis-
faction of the Development Preview, Con~mittee or
Architectural Review Conumittee.
d)
That no part of the use be permitted within 70 feet
oE the centerllne of Red Hill Avenue.
e)
That paved access be provided from the curb line
of Red Hill to the storage area.
That a cash or surety bond in the amount of $!,000
be posted with the City to guarantee replacemenU
of the paving in Red Hill Avenue which has bccn
extensively damaged by dirt-hauling operations
across Red Hill at the site subject to review and,
approval of the City Administrator and City AttOh-ney

g) That the use shall be removed if this parcel is
purchased by the City prior to expiration o~ the
permit.
h) Compliance with conditions 2, 3: and 6 within 14
days after approval of the permit..
PASSED AND ADOPTED at a regular meeting of the Plam~ing
Commission of the City of Tustln, California, held on.the 11th day of
August, 1969
