A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TUSTIN, CALIFORNIA, GRANTING A
CONDITIONAL USE PERMIT ON APPLICATION NO.

The Planning Commission of the City of Tustin, Call

does hereby resolve as follows:
1. The Planning Commission finds and determines:
_a) That a proper application (No. U. P. 69-290)
was filed on behalf of Thomas Bernatz, for a
Conditional Use Permit to permit a take-out
food establishment (taco shop) on the property
described in Exhibit A attached hereto ~:nd
incorporated herein by this reference.
b) That a public hearing on 'said application was
duly called, noticed and held.
c) That the establistLu~nt, maintenance and operati
of the use applied for will not, under the
circumstances of the particular case be detri-
mental to the health, safety, morals, comfort
and general welfare of the persons.residing or'
'working in the neighbOrhoo~ of the proposed
use and it will not be injurious or detrim~.nta~
to the property and improvements in the neighbo
hood or the general welfare of the City.
d) That said use should be permitted.
2. A Conditional Use Permit is hereby granted as
applied for, subject to the roi. lowing conditions:
a) That drive-thru facilities be Physically blocke
until C-2 zoning and a subsequent Use Permit fo
a drive-in restaurant have been approved.
b) That plans be submitted to the Architectural
Committee for review.
c) That all structural components, including
canopy projections, be located a minimum of 65
feet from the centerline of First Street.
d) That no outside dining shall be permitted.
e) That the provisions of the Improvement Agree-
ment entered into by Mr. Bernatz in conjunctio~.
with Parcel Map PM-68-13 be met prior to
