RESOLUTION NO. 1055 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT ON APPLICATION NO. U.P. 69-293 OF THONER AND BIRMINGHAM DEVELOPMENT COMPANY ON BEHALF OF MARY BROOMELL. .~iISSION OF THE CITY OF TUSTIN, CALIFOP~NIA, GPJkNTING CONDITIONAL US___~E PERMIT O~_~ APPLICATION N~. U. ~. 69-293 O~ THONER AND BI~,~ING~4 DEVELOPI'Z~NT CO~'iP~ ON ~JJH~LF OF HARY BROOMELL. / The Planning Commission of the City of Tustin, California does hereby resolve as follows: 1. The Planning Co~mission finds and determines: a) That an application (No. U. P. 69-293) was filed on behalf of Thoner and Birmingham Development Company on behalf of Mary Broomell for a Conditio%al Use Permit for approval of specific plans on the property described in Exhibit A attached hereto. b) That a public hearing was duly called, noticed and held on said application. c) The Commission finds that the establishment, maintenance and operation of.the use applied for will not, -under the circumstances of the particu- lar case be detrimental to the health, safety, morals, comfort and general welfare of the perso! residing or working in the neighborhood of the pr posed use and it will not be detrimental to the property and improvements in the neighborhood or the general welfarp of the City. d) That a Conditional Use Permit should be granted. 2. A Conditional Use Permit is hereby granted as applied for to approve specific plans for development of a 40 unit apartment subject to the following conditions: a) Approval of plans by the Architectural Committee. b) Approval and recordation of a Parcel Map separat- ing the commercial and residential portions of th~, property.
