RESOLUTION NO. 1051 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA GRANTING A CONDITIONAL USE PERMIT ON APPLICATION NO. P. 6~--286 OF DIVERSIFZED SHOPPING CENTEJ{~S~, .The Planning Conm]ission of the City of Tustin, californ does hereby resolve as follows: 1. The Planning Co:rm]ission finds and determines: a) That a proper application (No. U. P. 69-286) wa filed on behalf of Diversified Shopping Centers Inc., to permit 'development of a shopping compl, on the property described in Exhibit A attached hereto and incorporated herein by this referenc. That a public hearing on said application was duly called, noticed a~d held. c) That the establishmant, maintenance and operati of the use applied for will not, under the circumstances of the particular case be detri- mental to the health, safety, morals, comfort and general welfare of the persons residing or working in the neighborhood of the proposed use and it will not be injurious or detrimental ~o the property and improvements in the neighbor- hood or the general welfare of the C~ty. d) That said use should be permitted. 2. A Conditional Use Permit is hereby granted as appli for, subject to .the following conditions: a) Installation of three (3) on-site fire hydrants the location of which shall be approved by the Fire Chief. b} ' Installation of one (1) on-street fire hydrant, in addition to the existing hydrant, the locati of which shall be approved by the Fire Chief. c) Installation of a water line on the site to serve the three on-site hydrants and sufficient large in size to furnish 3,500 gallons per minute. d) Granting of additional street right-of-way for Walnut Avenue in accordance with the Master Plan of Arterial Highways. e) Granting of a 10' storm drain easement along th northerly and easterly lines of the parcel and 20-X 25' triangular corner cut-off area at Walnut and Red Hill. 5 g 12 14 15 16 17 22 23 24 25 26 .27 28 29 50 I[OURK'E & HOLI~ROOK ATTORNEYS AT LAW CROCK~-C~T~7. ENS ~ANTA ANA, CALIF. f) Provide adequate street lighting on both Walnut and Red Hill Avenues and annex entire propert~ to Tustin Lighting District. g) Construct full street improvements on Walnut Avenue to City standards and approval by the City Engineer. h) Ail public utilities shall be installed under- ground in conformance with accepted standards of utility companies. Street trees shall be provided ~.nd planted in accordance with City ordinances. j) - Construct storm drain facilities along Red Hill and Walnut frontages to the satisfaction of the City Engineer. k) Those segments of existing irrigation lines conflicting with or endangered by any proposed construction shall be removed and relocated or collapsed and backfilled, or otherwise made to conform to the specifications of the City of Tustin Building Code or to the satis£action of the City Engineer and the irrigation line owna 1) ' Signs for individual tenants shall be located' under the %~;alkway canopies or on walls and shal be limited to an area of two (2) square feet pe lineal foot of building, or portion of building frontage occupied by the tenant in which the main entrance to the business is located. m) Banners, bunting and flags (except City, State or Federal) shall be prohibited except for a grand opening period which is defined as one (1) month after issuance of final use and occupancy permit by the Building Department. n) Temporary promotional displays shall be limited to thirty (30) days per quarter the area of which sh~ll not exceed one-third of 'total window area. o) No merchandise shall be stored or displayed outside of an enclosed building. p) Outside activities shall be prohibited except for the dispensing of gas and oil products at the service station and drive-in facilities at the bank. q) Rental of trailers or other equipment, and t~e storage of same on the site, shall be prohibite r) The parking of trucks other than those neces- sarily involved in the station's operations on the site other than for minor servicing shall be prohibited. 1 1.0 ~0 · . ~ -, I. I S) No vending or dispensing machines shall be stored or raaintained outside of an enclosed building. t) Major overhaul of engines shall be prohibited. u) On-site lighting shall be designed to restrict direct rays to the site and the design of lighting structures shall be the same for the entire complex. v) A 6'8" solid masonry wall shall be constructed along property lines abutting residential districts, the height of which shall be measure from the grade on the shopping complex side of the wall. w) An additional trash area, screened as are the other trash areas, shall be located behind the southwest shop area. x) A total of 288 on-site parking spaces, construc ed to City Standards, shall be provided for the complex. y) Roof-top mechanical equipment for businesses other than Alpha Beta shall be located at the center of the building roof or shall be screene to the Satisfaction of the Architectural ConLmitte e. z) Roof-top mechanical equipment of the Alpha Beta Market shall be screened as indicated on sub- mitted plans. aa) Hours of operation shall be limited to 6;00 a.~. to 11:00 p.m. ~Sunday through Thursday, and 6:00 a.m. to midnight on Friday and Saturday.
