A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, GRANTING A CONDITIONAL
USE PERMIT ON APPLICATION NO. U.P. 69-287 OF
WESTERN FRANCHISE DEVELOPMENT CORPORATION FOR
WHALE ELECTRONICS.

The Planning Commission of the City of Tustin, California
does hereby resolve as follows:
1. The Planning Commission finds and determines:
a) That a proper application (No. U.P. 69-287) was
filed On behalf of Western Franchise Development
Corporation for %,~ale Electronics for a use permi
to allow a-take-out food establishment in the C-1
.. (Retail Commercial) zone. on the .p.roperty describ
in Exhibi. t A attached hereto and incorporated
herein by this reference.

b). That a Public hearin.g was duly'called, noticed
and held on. said application.

C) The Commission finds that the establishment,
maintenance and operation of the use applied for
will not, under the circumstances of the particu]
case be detrimental to the health, safety, moral~
comfort and general welfare of the persons resid~
or working in the neighborhood of the proposed
~se and it will not be injurious or detrimental t
the property and improvements in the neighborhood
or the_ general welfare of the City.
d) As additional grounds, the minutes and evidence
introduced at the hearing are included by referen
and made a part of the motion.
2. The Planning Commission hereby grants a Conditional
Use Permit to permit a take-out food establishment in the C-1
(Retail Commercial) zone..subject to the following conditions:
a) That street rightvo'f-way be granted in accordance
with the Master Plan of Arterial Highways.
b) That asphaltic concrete pavement, curb, sidewalk
and street trees be installed.
c) That street lights be installed.

d) That plans be submitted to the Architectural
Committee for review.'

Commission of the City of Tustin, California, held on the 10th day of February,
1969
