Trial of the eminent domain action to establish the amount the
City taust pay for the acquisition of the property adjacent to the
City Water facility at Main and Prospect is now coming to trial.
On or before February S, 1993, we need to make our final, formal
offer to the property owner. If the owner refuses that last formal
offer and proceeds to trial and obtains a verdict greater than that
offer, then the City is obligated to also pay the property owner's
attorneys' fees. Accordingly, we want to offer the lowest amount
which will be at least as much as our best estimate of what the
verdict may be if our offer is rejected and the case goes to trial.
The amount we racommend that the CmJncil authnH 7.A un to nffer to
the property owner is $265,000 plus applicable interest.
I will be ready to discuss this as fully as the Council
desires. Discussion can be in open session or, if the Council
prefers, in a closed session pursuant to Government Code
$54956.9(x).
