SUBJECT: ACCEPTIMPROVEMENTS FOR THE REMOVAL AND REPLACEMENT OF
HEATING, VENTILATION & AIR CONDITIONING (HVAC) UNITS AT THE
TUSTIN POLICE DEPARTMENT (CIP NO. 10032) AND AUTHORIZE THE CITY
ENGINEER TO FILE THE NOTICE OF COMPLETION
SUMMARY
Construction of the Removal and Replacement of Heating Ventilation & Air Conditioning
(HVAC) Units at the Tustin Police Department CIP No. 10032 has been completed to the
satisfaction of the City Engineer and is now ready for City Council acceptance.
RECOMMENDATION
It is recommended that the City Council:
1. Adopt Resolution No. 12-50 accepting the construction of the Removal and
Replacement of Heating Ventilation & Air Conditioning (HVAC) Units at the
Tustin Police Department CIP No. 10032; and
2. Authorize the City Engineer to execute and file the Notice of Completion with the
County Recorder's Office.
FISCAL IMPACT
The final construction cost for the Removal and Replacement of Heating Ventilation & Air
Conditioning (HVAC) System Improvement is $148,869.65, including $4,752.07 for two
additional electrical disconnects for isolation and future individual unit service needs.
DISCUSSION
The two HVAC units servicing the Police Department had experienced frequent failures
and reached the end of their 20 year useful life. This project provided for the removal and
replacement with two new units of similar size.
The City Council approved plans and specifications and authorized soliciting bids at the
December 6, 2011 meeting. Formal bids were received on January 10, 2012 and on
February 21, 2012 the City Council denied the bid protest by Allison Mechanical, Inc. and
awarded the construction contract for the project to the lowest responsive/responsible
bidder, TMCI, Inc.

Construction of this project was completed by TMCI, Inc. on May 19, 2012.
All of the work for the project has been completed to the satisfaction of the City Engineer
and is now�ady for City Council acceptance.

RESOLUTION NO. 12-50
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION FOR CONSTRUCTION OF THE REMOVAL AND
REPLACEMENT OF HEATING VENTILATION & AIR CONDTIONING
UNITS AT TUSTIN POLICE DEPARTMENT
WHEREAS, TMCI, Inc., having a contract with the City of Tustin to construct the
hereinafter described public works and improvement; and
WHEREAS, the City Engineer has duly certified to the construction of said public
improvement hereinafter mentioned in a manner satisfactory to the City Council of the
City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
works and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public works and improvement is found to be complete, and the same is
hereby accepted. Said public works and improvement is more particularly described as
follows:
The Removal and Replacement of Heating, Ventilation & Air Conditioning Units
at Tustin Police Department (CIP 10032)
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 5�h day of June 2012.
