SUBJECT: APPROVE A MODIFIED PROJECT FUNDING APPROACH AND AWARD THE
CONSTRUCTION CONTRACT FOR THE TUSTIN RANCH ROAD PHASE 2
ROADWAY IMPROVEMENTS PROJECT (COLLECTIVELY, CIP NO. 70100,
70204, 70206, 70214, & 70215), INCLUDING GEOTECHNICAL &
ENGINEERING CONSTRUCTION SUPPORT SERVICES
SUMMARY
In order to proceed as planned with Tustin Ranch Road Phase 2 Roadway Improvements
construction contract award, an interim funding approach is recommended until resolution of an
ongoing dispute with the State of California Department of Finance (DoF) to allow use of the MCAS
Tustin 2010 Tax Allocation Bond proceeds for their original intended purposes. While the dispute
on the use of the Bond proceeds may inevitably be decided by the legislature or courts, time is of
the essence.
RECOMMENDATION
It is recommended that the City Council:
Reaffirm previous project appropriations in the adopted Capital Improvement Program in
the amount of $2,800,000 Irvine Company — Developer Contribution, $4,500,000 City of
Irvine, $2,400,000 Irvine Ranch Water District Reimbursement, and appropriate $9,020,070
of Measure M2 Regional Capacity Program (RCP) — Project O/Proposition 1 B State-Local
Partnership Program (SLPP), $793,935 from unappropriated funds in CFD 06-01
Annexation Construction (Fund 438), and $6,000,000 from unappropriated funds in CFD
06-01 Construction (Fund 434) replacing previously appropriated Bond proceeds to the
Tustin Ranch Road Phase 2 Roadway Improvements Project for a total Phase 2 project
budget of $25,514,005;
2. Adopt Resolution 12-52 authorizing award of construction contract and making certain
findings pursuant to the California Environmental Quality Act, for the Tustin Ranch Road
Phase 2 Roadway Improvements Project to the lowest responsive/responsible bidder, R. J.
Noble Company, in the amount of $22,649,304.73 and authorize the Mayor and the City
Clerk to execute the contract documents on behalf of the City;
3. Approve Amendment No. 6 to a Consultant Services Agreement not-to-exceed the amount
of $240,700 with NMG Geotechnical, Inc. for required project geotechnical engineering and
materials testing; and
4. Approve Amendment No. 9 to a Consultant Services Agreement not-to-exceed the amount
of $259,000 with RBF Consulting for required project construction engineering support
services.

Sufficient MCAS Tustin 201OBond proceeds have always been encumbered under the bond
measure for this project. The Official Statement for the K8CAS Tustin 2010 Bond specifically
identifies that one of the primary purposes of the bonds was for the construction of the Tustin
Ranch Road Project as well as other Tustin Legacy Backbone Infrastructure Improvements.
The Successor Agency to the former Tustin {}onnnnunitv Redevelopment Agency continues to
contend that the MCA8Tustin 2010 Bond proceeds are an enforceable obligation. However, the
State of California Department of Finance (DoF) has indicated that the bond proceeds are not an
enforceable obligation. The modified interim funding approach io only recommended GSa means
to move forward with the project while the Succe8SorAoenoy pursues all efforts with the [>oF to
use bond proceeds for their authorized and intended use. The action taken in this regard should
not be misconstrued as a willful forfeiture 0f the intended purpose ofthe K8CA8 Tustin 2O1Obond
proceeds for improvements within the Tustin Legacy. Rather, it is an interim stopgap measure to
allow the City to meet its community goals and objectives pursuant tothe K8C/\G Tustin Specific
Plan/Reuse Plan. Should the DoF reconsider and approve the use CfK8CASTustin 2010 Bond
Pn}ceedo, the proceeds will be used to baohfi|| the Community Facility District Construction &
Annexation appropriations.
DISCUSSION
On August 2, 2011, the City Council and the former Tustin Community Redevelopment Agency
awarded the construction contract for the Tustin Ranch Road Phase 1 Grading and Gionn Drain
Project from Walnut Avenue to Warner Avenue. The construction effort for the entire Tustin Ranch
Road Extension project between Walnut Avenue on the north and Warner Avenue on the south
had been segregated into two phases to permit settlement to occur during fill placement and
grading of the northerly ov8ruroeain0 ramp prior to other street improvements and bridge

construction. This phasing of work also allowed the allocation of dewatering costs associated with
storm drain installation versus those future costs associated with sewer and water line installation
which will be an IRWD reimbursable expense.
A Notice to Proceed was issued August 29, 2012 for the Phase 1, consisting of clearing and
grubbing, mass grading, structural retaining wall, and storm drain/retention basin construction. An
action for Notice of Completion is expected June 19.
Preceding award of Phase 1, on July 19, 2011 the City Council and the former Tustin Community
Redevelopment Agency approved a pre-qualification package for general contractors for
construction of the Tustin Ranch Road Phase 2 Roadway Improvements Project. The pre-
qualification procedure was selected due to the specialized nature of construction and the
complexity of scheduling required for construction, including the deep IRWID underground utility
improvements in the vicinity of ongoing Navy groundwater clean-up operations near the southerly
Navy Hangar and the elevated bridge crossing over Edinger Avenue, SCRRA railroad tracks, and
the Santa Ana/Santa Fe Channel. On August 25, 2011, the City received submittals under the pre-
qualification process from twelve general contractors. Subsequently, on October 4, 2011 ten
general contractors were approved by the City and the Agency as qualified bidders for Phase 2.
Again, Phase 2 of this project, the subject of this recommended action, involves the construction of
the remaining underground utility work, sound walls, and street and landscape improvements,
including the Edinger Avenue/Railroad/Flood Control Channel bridge overcrossing.
Five (5) formal bids were received from the pre-qualified list of potential bidders and were publicly
opened on February 28, 2012 and reviewed by Public Works. These five bids are summarized
below by order of least dollar amount:

Proposals from both our Geotechnical Engineer and Engineer of Record were obtained in an
ongoing effort to support all related construction activity. Tasks include subgrade testing and
compaction, asphalt and concrete paving inspection and materials testing, bridge and sound wall
observation and testing, submittal review, shop drawing review and approval, review and response
to contractor request for information (RFI's), quantities validation, change order review and
support, costing and record drawings.
ENVIRONMENTAL
On January 16, 2001, the City of Tustin certified the Program Final Environmental Impact
Statement/Environmental Impact Report (FEIS/EIR) pursuant to the California Environmental
Quality Act (CEQA) and the National Environmental Policy Act (NEPA). On December 6, 2004,
the City Council adopted Resolution No. 04-077: (i) approving the Final Supplement #1 to the
FEIS/EIR, which specifically analyzed impacts associated with Tustin Ranch Road extension
between Walnut Avenue and Valencia Avenue; (ii) making certain findings; (iii) adopting a
Statement of Overriding Considerations; (iv) adopting a Mitigation Monitoring and Reporting
Program; and (v) approving the Tustin Ranch Road extension project. On April 3, 2006, the City
Council adopted Resolution No. 06-43 approving an Addendum to the FEIS/EIS. The FEIS/EIR,

its Supplement #1 to FEIS/EIS, and its Addendum collective constitute a program EIR under
CEQA, which considered the potential environmental impacts associated with development of the
former Marine Corps Air Station, Tustin.
An environmental checklist has been prepared and it has been determined that the proposed
project does not result in any new significant environmental impacts, substantial changes, or a
substantial increase in the severity of any previously identified significant impacts in the FEIS/EIR,
Supplement #1 to FEIS/EIR, and Addendum. Moreover, no new information of substantial
importance has surfaced since certification of the FEIS/EIR, Supplement #1 to FEIS/EIR, and
Addendum.
Mitigation for noise impacts to residential properties from the proposed project is included in Final
Supplement #1 to the FEIS/EIR as mitigation measures NR-1 through NR-7, and was adopted by
the City Council pursuant to Resolution No. 04-077. Mitigation measures NR-2, NR-3, NR-4, NR-
5, and NR-7 specifically provide for the City to provide for forced air ventilation, acoustic-rated
window/door assemblies, and related sound attenuation improvements in residential properties
along the east side of Tustin Ranch Road. However, despite the City's repeated and best efforts,
the owners of five of the affected properties have failed or refused to permit the City to provide for
certain of the sound attenuation improvements pursuant to mitigation measures NR — 1 through
NR -7.
Pursuant to the Findings of Fact and Statement of Overriding Considerations adopted by the City
Council pursuant to Resolution No. 04-077, the City Council previously determined that if private
property owners do not permit the City to make the improvements called for in mitigation measures
NR-1 through NR-7 in a timely manner, then these mitigation measures will be infeasible, and
noise impacts from the proposed project will be unavoidable. Consistent with this previous
determination, Resolution No. 12-52 includes findings that the implementation of mitigation
measures NR-2, NR-3, NR-4, NR-5, and NR-7 at the five residential properties referenced above is
infeasible due to the property owners' failure and/or refusal to permit the City to provide for the
improvements identified in these mitigation measures in a timely manner, and that, as a result, the
noise impacts occurring at these five residential properties constitute unavoidable impacts, which,
pursuant to the Statement of Overriding Considerations adopted pursuant to Resolution No. 04 —
077, the City Council has previously determined to be outweighed by the benefits of the project.

FINDINGS PURSUANT TO THE CALIFORNIA

WHEREAS, it is the intention of the City Council of the City of Tustin, California
to contract for the Tustin Ranch Road, Valencia Avenue, Park Avenue, and Legacy
Road Phase 2 Roadway Improvements Construction Project (CIP No. 70100, 702204,
70206, 70214, and 70215 (the "Project"); and
WHEREAS, on January 16, 2001, pursuant to the California Environmental

importance has surfaced since certification of the FEIS/EIR, Supplement #1 to
FEIS/EIR, and Addendum; and

WHEREAS, mitigation for noise impacts to certain residential properties
(identified as residential Receptors 1 through 21) from operation of the Tustin Ranch
Road is included in Final Supplement #1 to the FEIS/EIR as mitigation measures NR-1
through NR-7 and were adopted by the City Council pursuant to Resolution No. 04-077;
and
WHEREAS, mitigation measures NR-2, NR-3, NR-4, NR-5, and NR-7 specifically
provide for the City to provide for forced air ventilation, acoustic-rated window/door
assemblies, and related sound attenuation improvements in residential Receptors 1
through 21, if and where needed; and
WHEREAS, the City has offered, in good faith, to provide for noise attenuation
improvements pursuant to mitigation measures NR-1 through NR-7 at each of these 21
residential properties; and
WHEREAS, despite the City's repeated and best efforts, the owners of the
property constituting residential Receptors 2, 4, 14, 15, and 20 have failed or refused to
permit the City to provide for certain of the sound attenuation improvements pursuant to
mitigation measures NR-1 through NR-7; and
WHEREAS, pursuant to the Findings of Fact and Statement of Overriding
Considerations adopted by the City Council pursuant to Resolution No. 04-077, the City
Council found that (i) if private property owners do not permit the City to make the
improvements called for in mitigation measures NR-1 through NR-7 in a timely manner,
then these mitigation measures will be infeasible, and noise impacts from the proposed
project will be unavoidable; and (ii) the benefits of the proposed project outweigh the
unmitigated unavoidable adverse impacts of the project; and
WHEREAS, on August 2, 2011, the City of Tustin awarded a construction
contract for the Tustin Ranch Road Grading and Storm Drain Phase 1 project to
Sandoval Pipeline Engineering; and
WHEREAS, on October 4, 2011, the City of Tustin pre-qualified ten general
contractors as eligible to bid on the Phase 2 construction contract for the Project; and
WHEREAS, on December 6, 2011, pursuant to Resolution No. 11-87, the City
Council of the City of Tustin approved the plans and specifications for the Project and
authorized the City Clerk to advertise for the receipt of bids or proposals from the ten
pre-qualified general contractors for the performance of the work specified in the
approved Project plans and specifications; and
WHEREAS, the City received bids from five (5) of the pre-qualified general
contractors, which were publicly opened and read on February 28, 2012, and all of
which City staff determined to be responsive; and

WHEREAS, City staff has determined that the bid submitted by R.J. Noble
Company, in the amount of $22,649,304.73, was the lowest responsive bid submitted.
NOW THEREFORE, the City Council of the City of Tustin hereby resolves as
follows:
Section 1. The above recitals are true and correct.
Section 2. The City Council hereby makes the following findings:
(a) that all related environmental impacts associated with the construction and
use of the Project were considered in the FEIS/EIR, Supplemental #1 to FEIS/EIR, and
Addendum and all applicable implementation measures and mitigation measures are
identified in the Mitigation Monitoring and Reporting Program approved by the Tustin
City Council for the FEIS/EIR, Supplemental #1 to FEIS/EIR, and the Addendum.
(b) implementation of mitigation measures NR-2, NR-3, NR-4, NR-5, and NR-7 at
residential Receptors 2, 4, 14, 15, and 20 is infeasible due to the property owners'
failure and/or refusal to permit the City to provide for the improvements identified in
these mitigation measures in a timely manner;
(c) due to the property owners' failure and/or refusal to permit the City to provide
for noise attenuation improvements pursuant to mitigation measures NR-1 through NR-
7, noise impacts occurring at residential Receptors 2, 4, 14, 15, and 20 constitute
unavoidable impacts, which, pursuant to the Statement of Overriding Considerations
adopted pursuant to Resolution No. 04-77, the City Council has previously determined
to be outweighed by the benefits of the Project.
Section 3. The Director of Public Works, or his designee, is authorized and directed
to file the Notice of Determination for the Project and any other documents in
accordance with the requirements of CEQA and the City's CEQA procedures.
Section 4. The City Council hereby:
(a) finds the that the bid submitted by R.J. Noble Company is the lowest
responsible, responsive bid submitted for the Tustin Ranch Road, Valencia Avenue,
Park Avenue, and Legacy Road Phase 2 Roadway Improvements Construction Project
(CIP No. 70100, 702204, 70206, 70214, and 70215 (the "Project");
(b) waives all irregularities in the bid submitted by R.J. Noble Company;
(c) awards the construction contract for the Project to R.J. Noble Company in the
amount of $22,649,304.73, conditioned on its timely execution of the Project contract
and submission of all required documents, including but not limited to, executed bonds,
certificates of insurance, and endorsements, in accordance with the Project documents;
and

(d) authorizes the Mayor and City Clerk to execute the contract documents on
behalf of the City.
Section 5. If any provision, section, subsection, sentence, clause, phrase or word of
this Resolution is for any reason held to be invalid by a court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions of this Resolution.
The City Council hereby declares that it would have passed and adopted this
Resolution, and each and all provisions hereof, irrespective of the fact that one or more
provisions may be declared invalid.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
of the City of Tustin, California, held on the 5th day of June, 2012.

At your request, NMG Geotechnical, Inc. (NMG) is pleased to submit this proposal for geotechnical
observation and testing during upcoming construction of the Phase 2 street and utility improvements
for the subject roadways. The scope of work and cost estimate for Phase 2 is based on: the request
for proposal (RFP); our review of the new project plans, bid documents and addenda; our familiarity
with the project and construction team. We understand that the Phase 2 work will begin sometime
after the completion of Phase 1 and that the apparent low bidder is R.J. Noble.

SUMMARY OF ADDITIONAL SERVICES AND BUDGET REQUEST FOR PHASE 2
The anticipated geotechnical observation and testing services for the upcoming construction of the
Phase 2 utility and street improvements are based on the following assumptions.
• NMG will provide pre - construction services that include review and preparation of
geotechnical- related project special provisions, technical specifications, exhibits, response to
review questions, meetings, and communication and coordination with the project team. The
County of Orange Public Works has requested NMG to perform an additional boring and
response report adjacent to the flood control channel. This work is being performed in
conjunction with RBF and requires special permitting.
• The entire project will be subject to Prevailing Wage guidelines.
• The construction duration is a total of 300 working days.
• The work is under the jurisdiction of the city of Tustin. Testing services will be conducted in
conformance with ASTM methods.
• The IRWD Non - Capital improvements within the site are included as part of the proposed
improvements to be done by the city. The scope of work and cost estimate is provided
separately.
• The IRWD Capital improvements are not included within the project work. IWRD will contract
for these services separately.
• NMG will prepare one final report for observation and testing performed during the project.
• Observation and testing will be necessary for the grading and demolition of existing
improvements near the intersection of Tustin Ranch Road (TRR) with Walnut Avenue. This
grading and demolition will include:
- Demolition of curb and gutter, driveway, trash enclosure and sidewalk for the construction
of a right turn lane from Walnut onto TRR.
- Removal of a short section of RCP, 11 feet at approximately 7 feet in depth, near the
intersection.
- Removal of asphalt for the construction of the proposed medians on Walnut.
- Removal of pull boxes, a catch basin, 517 feet of existing wall and 26 trees in the area that
will require grading.
- Re- grading of the existing slope and the un- graded portion of TRR at the intersection.
Grading will include some remedial removals (to be determined) and approximately 14,130
cubic yards of unclassified excavation.
• The backfill observation and testing for the street and utility improvements will include:
- Installation of approximately 10 of 18 -inch RCP.
- Installation of 2 culverts and 15 parkway drains.
- Installation of 36 catch basin/inlets.
- Approximately 24,355 feet of dry utility trenches.
- Seventeen pull boxes and a gas pit.

• The backfill observation and testing for the IRWD Non - Capital improvements domestic water
line construction will include:
- Installation of approximately 430 feet of 8 -inch domestic water line — depth ranges from 4 to
5 feet.
- Installation of approximately 1,195 feet of 10 -inch water line — depth ranges from 4 to
5 feet.
The backfill observation and testing for the IRWD non - capital improvements recycled water
line construction will include:
- Installation of approximately 385 feet of 4 -inch recycled water line, 25 feet of this recycled
water line is within the SCZ — depth ranges generally from 5 to 6 feet
- Installation of four copper recycled water services
- Backfill for the removal of approximately 270 feet of existing recycled water line
• Street improvement construction will include a portion of Legacy, Valencia and Park Avenue,
TRR from Warner to Walnut and median and turn lane improvements on Walnut. The street
improvement construction will include subgrade and, for some items, aggregate base
observation and testing for:
- Curb and gutter subgrade — approximately 43,500 feet.
- 11,070 square feet of subgrade and aggregate base for bus turn-outs (10 total).

overlay on Walnut (approx. 1,000 feet) — 15,451 tons.
• The project will include the construction of a bridge over Edinger Street. Our scope is assumed
to include geotechnical observation and testing only. Special inspections and materials testing
for the bridge will be performed by others.
• Observation and testing during the construction of the bridge is anticipated to include:

- Subgrade for the foundation excavations for the piers, wing -walls and abutments.
- Subgrade for the slope concrete below the abutments.
- Backfill of the bridge abutments and wing -walls — approximately 1,792 cubic yards.
- Backfill around and above the foundations for the bridge construction.
• Pile Dynamic Analysis (PDA) to monitor strains and accelerations during driving operations
is not included at this time. PDA could be used to accurately evaluate the pile driving stresses
in order to prevent damage, evaluate the performance of the hammer to examine driving
system efficiency, and pile capacity and length.
The project will include the construction of four sound walls. The walls will be constructed on
caisson and grade beam foundations. Wall 1 is a free- standing wall, approximately 1,220 feet in
length and ranging from 8 to 10 feet high. Wall 2 is partially retaining (1 to 3 feet) and is
approximately 360 feet long and up to 10 feet in height. Wall 3 is also partially retaining (1 to 3
feet), 560 feet in length and also up to 10 feet in height. Wall 4 is a free- standing wall,
approximately 250 feet long and up to 11 feet high.
• Observation and testing during construction of the walls is anticipated to include:
- Full -time observation and testing during foundation caisson drilling.
- Foundation excavation subgrade.
- Backdrain installation for the retaining portions of the walls — Walls 2 and 3.
- Backfill for the retaining portions of the walls — Walls 2 and 3.
• Special inspections and materials testing services during the sound wall construction will be
performed by others.
• No special inspections or materials testing will be required for the sewer, domestic water and
recycled water improvements. If required, the special inspection and material testing for the
utility improvements will be performed by others.
• Special inspection and material testing for the street improvements will be performed by others.
• NMG will provide source inspection for the asphalt as requested by the City.
• Special inspection and material testing for the bridge will be performed by others.
• Monitoring of the pile driving operation for the bridge is not included.
• Geotechnieal design review and construction services for temporary shoring are not included.
• Geotechnical services for the abandonment of wells or other utilities that may be encountered

propose to perform this work on a time- and - material and as- needed basis, in accordance with the
attached 2009 Professional Fee Schedule. The estimated costs may vary by task, but the total would
not be exceeded without your prior authorization.
