STACK, DIRECTOR OF PUBLIC WORKS /CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 12 -55 TO APPROVE THE SUBMITTAL OF STATE - LOCAL PARTNERSHIP PROGRAM (SLPP) FORMULA GRANT APPLICATIONS TO THE ORANGE COUNTY TRANSPORTATION AUTHORITY SUMMARY City Council adoption of Resolution No. 12 -55 will approve the submittal of the City's project applications for funds under the Orange County Transportation Authority (OCTA) SLPP Formula Grant Call for Projects. It will also delegate signature authority to the City's Director of Public Works /City Engineer to facilitate delivery of the projects. The OCTA requires City Council approval as part of the application process. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 12 -55 approving the submittal of project applications to the Orange County Transportation Authority (OCTA) for funding under the State -Local Partnership Program (SLPP) Formula Grant Call for Projects. FISCAL IMPACT The City of Tustin's formula share of available state Proposition 1 B SLPP funds is estimated to be approximately $519,411. The City of Tustin is also requesting $73,500 of the City of Santa Ana's formula share for their portion of the McFadden Avenue Rehabilitation Project. Cities are required to provide minimum match funding of fifty percent (50 %), using Measure "M" Turnback or Measure "M2" Fair Share funds, which will be requested in the City's Fiscal Year 2012 -2013 Capital Improvement Program Budget. The City of Santa Ana will also provide $73,500 for their required match. DISCUSSION /BACKGROUND California voters approved the Proposition 1 B Highway Safety, Traffic Reduction, Air Quality, and Port Security Bond Act of 2006, which makes State and Local Partnership Program (SLPP) funds available to the Orange County Transportation Authority (OCTA). Of the total SLPP funds available, the OCTA has programmed $34.7 million for highway projects and $27.9 million to local agency projects. To utilize OCTA's remaining share of SLPP funds, estimated to be between $20 million and $21 million, OCTA will distribute funds on a formula basis to local Orange County agencies for eligible projects under the SLPP Formula Grant Call for Projects. On April 23, 2012, the Board of Directors of the OCTA approved the guidelines for local agencies to apply for funding under the SLPP Formula Grant and authorized their staff to issue a one -time call for projects. Agencies are requested to submit projects in priority order to meet their share of SLPP funding and also provide backup project(s) beyond their estimated formula share, in case additional funding becomes available. The City of Tustin's formula share is estimated to be between $511,656 and $519,411. The upper limit of the range was used for purposes of completing the applications per the direction of OCTA staff. Agencies are required to provide State -Local Partnership Program (SLPP) Formula Grant Applications to OCTA June 19, 2012 Page 2 minimum match funding of fifty percent (50 %), using Measure "M" Turnback and /or Measure "M2" Fair Share funds. Eligible projects include, but are not limited to, improvements to the local road system, including major roadway rehabilitation, resurfacing, or reconstruction that extends the useful life by at least fifteen (15) years; new construction of facilities to increase capacity, improve mobility, or enhance safety; and improvements to bicycle or pedestrian safety or mobility with a useful life of at least fifteen (15) years. Only the construction phase of a project is eligible. The design costs will be funded from Measure "M" Turnback or Measure "M2" Fair Share funds as appropriate. The City's proposed FY 2012 -2013 CIP Budget will incorporate these costs. City staff has prepared project applications in order of priority as follows: * The southerly twenty (20) feet of the existing street right -of -way on McFadden Avenue between Mantle Lane and the 55 Freeway, lies within the City of Santa Ana. Therefore, a Cooperative Agreement will be established between the City of Tustin and the City of Santa Ana for the McFadden Avenue Rehabilitation Project, with the City of Tustin acting as the lead agency for the project. ** If additional SLPP funding beyond the estimated amount of $519,411 is not available, then SLPP funding will be capped at $109,411 and the difference of $55,589 between $165,000 and $109,411 will be funded with Measure "M" Turnback and /or Measure "M2" Fair Share funds. * ** If additional SLPP funding becomes available, the fifty percent (50 %) match of $175,000 will be funded with Measure "M" Turnback and /or Measure "M2" Fair Share funds. The applications for these projects were submitted to the OCTA by its deadline of May 14, 2012. Adoption of the City's resolution after that date is acceptable to the OCTA and serves to complete the initial administrative process for receipt of the applications. Therefore, staff is requesting City Council adoption of Resolution No. 12 -55, which authorizes application for funds under the SLPP Formula Grant Call for Projects and delegates signature authority to the Director of Public Works /City Engineer to facilitate delivery of the projects. WHEREAS, the California voters approved Proposition 1B Highway Safety, Traffic Reduction, Air Quality, and Port Security Bond Act of 2006, which makes State - Local Partnership Program (SLPP) funds available to the Orange County Transportation Authority (OCTA); and WHEREAS, OCTA has established the procedures and criteria for nominating proposals; and WHEREAS, the City of Tustin possesses authority to nominate projects funded using Measure "M" Turnback, Measure "M2" Fair Share, and State -Local Partnership Program funding and to finance, acquire, and construct the proposed projects; and WHEREAS, by formal action, the City Council of the City of Tustin authorizes the nomination of the Newport Avenue Bicycle Trail Reconstruction Project between Main Street and Irvine Boulevard, the Enderle Center Drive and Vandenberg Lane Intersection Safety Enhancements Project, the McFadden Avenue Rehabilitation Project between Mantle Lane and Pasadena Avenue, the Irvine Boulevard Rehabilitation Project between Prospect Avenue and Holt Avenue, and the Red Hill Avenue Rehabilitation Project between San Juan Street and Bryan Avenue, including all understanding and assurances contained therein, and authorizes the person identified as the official representative of the City of Tustin to act in connection with the nomination and to provide such additional information as may be required; and WHEREAS, the City of Tustin will maintain and operate the property acquired, developed, rehabilitated, or restored for the life of the resultant facilities or activity; and WHEREAS, with the approval of the California Department of Transportation (Caltrans), California Transportation Commission (CTC), and OCTA, the City of Tustin or its successors in interest in the property may transfer the responsibility to maintain and operate the property; and WHEREAS, the City of Tustin will give Caltrans, CTC, and OCTA's representatives access to and the right to examine all records, books, papers or documents related to the projects; and WHEREAS, the City of Tustin will cause work on the projects to be commenced within six months following notification from the State that the funds have been allocated by the CTC and that the projects will be carried to completion with reasonable diligence; and WHEREAS, the City of Tustin commits $630,589 of City of Tustin's Measure "M" Turnback and Measure "M2" Fair Share funds to provide at least fifty percent (50 %) of total project construction costs as match to the requested $519,411 in OCTA Formula SLPP funds for total project costs within the City of Tustin estimated to be $1,150,000; and WHEREAS, the City of Tustin commits $175,000 of City of Tustin's Measure "M" Turnback and Measure "M2" Fair Share funds to provide at least fifty percent (50 %) of total project construction costs as match to the requested $175,000 in OCTA Formula SLPP funds for a total project cost estimated to be $350,000 for the City's backup project, Red Hill Avenue Rehabilitation between San Juan Street and Bryan Avenue, in case additional OCTA Formula SLPP funds become available; and WHEREAS, the City of Tustin will comply where applicable with provisions of the California Environmental Quality Act, the National Environmental Policy Act, the Americans with Disabilities Act, and any other federal, state, and /or local laws, rules and /or regulations; and WHEREAS, the City Council of the City of Tustin authorizes the execution of any necessary cooperative agreements between the City of Tustin and OCTA to facilitate the delivery of the projects; and WHEREAS, the City Council of the City of Tustin authorizes the revision of the City of Tustin Capital Improvement Program to facilitate the delivery of the projects; and WHEREAS, the City Council of the City of Tustin delegates signature authority to its Director of Public Works /City Engineer to facilitate the delivery of the projects; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin, hereby authorizes its Director of Public Works /City Engineer as the official representative of the City of Tustin to apply for the State -Local Partnership Program funding under the Proposition 1B Highway Safety, Traffic Reduction, Air Quality, and Port Security Bond Act of 2006 for the Newport Avenue Bicycle Trail Reconstruction Project between Main Street and Irvine Boulevard, the Enderle Center Drive and Vandenberg Lane Intersection Safety Enhancements Project, the McFadden Avenue Rehabilitation Project between Mantle Lane and Pasadena Avenue, the Irvine Boulevard Rehabilitation Project between Prospect Avenue and Holt Avenue, and the Red Hill Avenue Rehabilitation Project between San Juan Street and Bryan Avenue. BE IT FURTHER RESOLVED that the City of Tustin agrees to fund its share of the project costs and any additional costs over the identified programmed amount.
