WHEREAS, the California voters approved Proposition 1B Highway Safety,
Tragic Reduction, Air Quality, and Port Security Bond Act of 2006, which makes State -
Local Partnership Program (SLPP) funds available to the Orange County Transportation
Authority (OCTA); and
WHEREAS, OCTA has established the procedures and criteria for nominating
proposals; and
WHEREAS, the City of Tustin possesses authority to nominate projects funded
using Measure "M" Turnback, Measure "M2" Fair Share, and State - Local Partnership
Program funding and to finance, acquire, and construct the proposed projects; and
WHEREAS, by formal action, the City Council of the City of Tustin authorizes the
nomination of the Newport Avenue Bicycle Trail Reconstruction Project between Main
Street and Irvine Boulevard, the Enderle Center Drive and Vandenberg Lane
Intersection Safety Enhancements Project, the McFadden Avenue Rehabilitation Project
between Mantle Lane and Pasadena Avenue, the Irvine Boulevard Rehabilitation
Project between Prospect Avenue and Holt Avenue, and the Red Hill Avenue
Rehabilitation Project between San Juan Street and Bryan Avenue, including all
understanding and assurances contained therein, and authorizes the person identified
as the official representative of the City of Tustin to act in connection with the
nomination and to provide such additional information as may be required; and
WHEREAS, the City of Tustin will maintain and operate the property acquired,
developed, rehabilitated, or restored for the life of the resultant facilities or activity; and

WHEREAS, with the approval of the California Department of Transportation
(Caltrans), California Transportation Commission (CTC), and OCTA, the City of Tustin
or its successors in interest in the property may transfer the responsibility to maintain
and operate the property; and
WHEREAS, the City of Tustin will give Caltrans, CTC, and OCTA's
representatives access to and the right to examine all records, books, papers or
documents related to the projects; and
WHEREAS, the City of Tustin will cause work on the projects to be commenced
within six months following notification from the State that the funds have been allocated
by the CTC and that the projects will be carried to completion with reasonable diligence;
and
WHEREAS, the City of Tustin commits $630,589 of City of Tustin's Measure "M"
Turnback and Measure "M2" Fair Share funds to provide at least fifty percent (50%) of
total project construction costs as match to the requested $519,411 in OCTA Formula
SLPP funds for total project costs within the City of Tustin estimated to be $1,150,000;
and
WHEREAS, the City of Tustin commits $175,000 of City of Tustin's Measure "M"
Turnback and Measure "M2" Fair Share funds to provide at least fifty percent (50%) of
total project construction costs as match to the requested $175,000 in OCTA Formula
SLPP funds for a total project cost estimated to be $350,000 for the City's backup
project, Red Hill Avenue Rehabilitation between San Juan Street and Bryan Avenue, in
case additional OCTA Formula SLPP funds become available; and
WHEREAS, the City of Tustin will comply where applicable with provisions of the
California Environmental Quality Act, the National Environmental Policy Act, the
Americans with Disabilities Act, and any other federal, state, and /or local laws, rules
and /or regulations; and
WHEREAS, the City Council of the City of Tustin authorizes the execution of any
necessary cooperative agreements between the City of Tustin and OCTA to facilitate
the delivery of the projects; and
WHEREAS, the City Council of the City of Tustin authorizes the revision of the
City of Tustin Capital Improvement Program to facilitate the delivery of the projects; and
WHEREAS, the City Council of the City of Tustin delegates signature authority to its
Director of Public Works/City Engineer to facilitate the delivery of the projects;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tustin, hereby authorizes its Director of Public Works/City Engineer as the official
representative of the City of Tustin to apply for the State-Local Partnership Program
funding under the Proposition 1B Highway Safety, Traffic Reduction, Air Quality, and

Port Security Bond Act of 2006 for the Newport Avenue Bicycle Trail Reconstruction
Project between Main Street and Irvine Boulevard, the Enderle Center Drive and
Vandenberg Lane Intersection Safety Enhancements Project, the McFadden Avenue
Rehabilitation Project between Mantle Lane and Pasadena Avenue, the Irvine
Boulevard Rehabilitation Project between Prospect Avenue and Holt Avenue, and the
Red Hill Avenue Rehabilitation Project between San Juan Street and Bryan Avenue.
BE IT FURTHER RESOLVED that the City of Tustin agrees to fund its share of
the project costs and any additional costs over the identified programmed amount.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 19th day of June 2012.
