ORDINANCE NO. 222
AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA,
REGULATING PLACES FREQUENTED BY MINORS.
The City Council of the City of Tustin does ordain as follows:
Section 1: All Places within the City of Tustinwhere minors
gather, congregate, come and go, attend, or are a~racted to are
hereby made subject to the provisions of this part, All such
regulated places are found to be likely to affect injuriously the
public health, safety, morals and welfare.
Section ~: No place regulated hereunder shall maintain
any condition or conditions which pose a threat or harm or are
dangerous or deleterious to the health, morals, welfare or safety
of minors.

such place does pose a threat or harm or is dangerous or deleterious
to the health, morals, welfare or safety of minors, a Notice in
writing shall be mailed, postage prepaid, to the last a~dress
known to the Chief of Police for the person lost known to be the
owner, lessee, occupant or Eager of the premises, that such a
determination has been made.
Section 4: If no request for hearing is made innwriting
within five (5) days following such written notice, by any owner,
lessee, occupant or manager, the determLnation by the Chief of Police
shall automatically become final.
Section ~: Upon receipt by any of the said persons of such
a notice, they may, within five (5) days thereafter d&liver to the
Chief of Police, in writing, their request for a hearing. Such
request shall state whether the person requests a private or a public
hearing. Upon receipt of such request for hearing, the Chief of Police
shall set a public hearing before the City Council if a public hearing
is requested, or a private hearing before the Chief of Police, if
a private hearing is requested. Said hearing shall be set for a date
within thirty (30) days following such request for hearing. Notice in
writing shall be given to the party or parties requesting such hearing,
at least five (5) days before such hearing.

~Section 6: At said hearing there shall be presented the
evidence upon which the determination has first been made, and the
ewner, occupant, lessee or manager of the premises shalll be affonied
an opportunity to present such evidence and arguments as he may
desire. At the close of said hearing, a determination shall be made
as to whether or not said place~ poses a threat or harm or is deleterious
to the health, moral~, welfare or safety of minors.
~S~ction 7: Upon a determination as hereinabove provided that
such place does pose a threat or harm or is deleterious to the health,
morals, welfare or safety of minors, a Notice in writing of said deter-
mination shall be given to the owner, ~essee, occupant or manager that
said place shall close, within f~ve (5) days after said notice is
received, unless evidence to the satisfaction of either the City
Council or the Chief of Police has been presented, showing correction
or elimination of such condition prior to said time.
Section 8: Upon any determination as herein provided that
any business does pose a threat or harm or is d~ngerous or deleterious
to the health, morals, welfare or safety of minors, no business
license shall be issued for the premises until such condition or
circumsatances have been corrected to the satisfaction of the City
Council or the Chief of Police, and any existing business license
shall be automatically revoked.
Se. ction ~: After such written notice has been given as
provided herein, it shall be unlawful for any person to contiue to
maintain said pr~mises or cause the same to be maintained or open
to the public or to mL~ors, or to allow minors upon Said premises.
Section lO: Any person who shall ~iolate any of the
provisions of this part shall be deemed guilty of a misdemeanor, and
shall be punished by a fine not exceeding $500.00, or imprisonment for
a term not exceeding six months, or by both such fine and imprison-
me nt.

that the whole number of the members of the City Council of the City
of Tustin is five; that the above and foregoing Ordinance was duly
and regularly introduced and read at the regular meeting of the
C~ty Council held on the 6th day of May, 1963, and was given its
second reading and duly passed and adopted at a regular meeting
held on the 20th day of May, 1963, by the following vote:
