V. 66-167 BY O'S INCORORATED. ~",,,,~-/ 2% P~SOLL~TON OF TPIE PT.~ING COMMISSION OF THE C]~ OF TDSTTN, C~L]FO~IA, GR2%NTING A V2%RI2%NCE ON 2%?PLIC2%TIOH NO. V. 66-167 BY OJ ' S, INCORPORATED. The Planning Commission of the Cit~ of Tustin, Califor- nia, does resolve as follows: section 1: The Planning Commission finds and determine~ as follows: A) That a proper application (No. V. 66-167) was filed} on behalf of OJ's IncorPorated for a variance from the required front yard sixty foot (60') set back to twenty feet (20') on the property located on the south side of Fourth Street coming 455 feet east of the center line of Prospect, and continuing east 100 feet {. along Fourth Street. B) That a public hearing was duly called, noticed'and · held on said application. ' C) That the subject property has peculiar geographical circumstances which make the imposition of the required="front yard set back more burdensome on it' than other properties in the same zone and area. . D) That granting the said variance; would not be detri- mental to the ad3acent properties or uses, to the general neighbor- hood, nor to the general plan of the City of TuStin, and should be granted. Section 2: The Planning Commission hereby grants the variance, as applied for, to permit the reduction of the front Yard set back to twenty feet (20') from the front property line subject to the following conditions: A) The twenty feet (20') front yard set back area ( · with the exception of the access drive) be limi'ted only to land- scaping and that no portion of the building or related signs be constructed in this set back area; ! 1 4 5 6 ? 9 10 3.2 15 16 17 .t9 £0 22 25 ~9 30 B) That provisions be made for landscaping of the parking lot area, especially that portion which lis adjacent to ~ Fourth Street; ~ C) That appropriate street trees be planted in accordance with the established Street Tree Program for the City of Tustin. Approval of such planning to be sub3ect to Department of Public Works, City of Tustin. D) That no provisions be made or allowed in the plans or structure for: 1. Automobile service 2. Outside eating facilities, i.e., tables, benches. 3. An outside service window E) That detailed landscaping plans, building plans and proposed signs be submitted to the Architectural Committee for approval, as modified by the Planning Commission; that said approval by the Architectural Committee be final and binding and that said approval be a specific condition of the granting of this variance. Section 3: The approval of the above variance does not establish criteria for future variances of a similiar nature on the remaining property; each subsequent request wili be de~ermined upon its individual merits.
