AN ORDINANCE OF THE CITY OF TUSTIN,
CALIFORNIA, REGULATING THE ISSUANCE OF
PERMITS FOR FOOD HANDLING BUSINESSES,
AND PROVIDING A PENALTY FOR THE VI~
OLATION THEREOF; AND REPEALING ORDINANCES
NUMBERS, 11, 12, 72 AND 127.
The City Council of the City of Tustln, Ca!!f- ~ ~
ornia, does ordain as follows:
SECTION Z~..: Pemits. It shall be u~lawfut for
any person, firm or corporation owning, controlling or
leasing, acting as agent for., conducting, operating or
managing any restaurant, cafe, lunch counter, cafeteria,
soda fountain, ice cream parlor, soft drink stand, fruit
and vegetable stand, g~ocery, meat market, bakery, pop-
corn, peanut or other food vending stands .or stations,
food processing or manufacturing plants, bottling plants,
or. other places or vehicles Zn the City of .~stin where
food is perpared for sale, sold distributed, or displayed
for sale, or for any other reason, to conduct or operate,
or cause or permit t~ be conducted or Operated in said
City of Tustin such restaurant, care, lunch counter, cafe-
teria, soda fountain, ice cream parlor, sQftdrink stand,
fruit and vegetable stand, grocery, meat market, bakery
popcorn, peanut orother food vending stands or stations,
or vehicles, where food is prepared for sale, sold, dis-
tributed, or displayed for sale, or for any other reason,
or for any person to sell, or offer for sale, or cause
or permit to be sold or offered for sale, or for any other
reason, any food or drink therein or therefrom without
first complying with all State and/or local laws, o~in-
ances and regulations, and without first applying fo~~ :'~
and receiving from the Health Department of the City of
~stin a permit therefor.
A pemlt for which app!icatlon is made under
the provisions of this Ordinance, may be granted at
any time during the year, but all permits granted here-
Under shall expire at the end of the calendar/fiscal
year. The Permit shall be posted in a conspicious
place on the property.
.S. ection 2: Ex.ception. s... Provided, that this
Ordinance shall not apply to cigar stands or other places
or vehicles or businesses where no food of any kind or
n~ture is offered for sale or sold, other than candy or
soft drinks received in sealed packages, boxes or bottles,
where the seal or seals on said package, box or bottle
are not broken prior to sale thereof, or vehicles en-
gaged in the delivery of food products to ~etail estab-
lishments for resale°
Section 5: I~n~p~ect.i,o.n. It shall be lawful
for any member or employee of the Health Department of
the City of Tustin to enter and go upon any premises here-
in mentioned at any time for the purpose of inspecting
the same and any member of the Health Department may re-
quire any person owning a permit under this Ordinance
to produce the same for inspection. If such inspection
be refused, the permit shall be forthwith revoked.
.S~ct~.o~n...~.:.. Pg~mit Suspensions.. A permit which
has been issued under the provisions of this Ordinance
may be temporarily suspended by the Health Officer upon
violation by the holder of any State or local laws, or-
dinances or ~egulations pertaining to the purity of a
food product or the sanitation of food handling estab-
lishments, or revoked if the ~i~lation is not corrected
after an appropriate notice of such violation has been
served by the Health Officer.
Section ~: Re~ulations The City Health
Officer is hereby authorized to adopt and enforce regu-
lations relating to health and sanitation pursuant to
this Ordinance. Any person, firm or corporation making
application for a food handling permit shall comply with
all such regulations prior to receiving a permit. Such
regulations may require that any new construction or al-
terations of food establishments shall conform to sani-
tary standards; that food be adequately protected from
contamintation!v.a~d spoilage; that employees be free 0f
communicable or infectious diseases and observe safe
food handling practices; that food handling equipment
and utensils be constructed, stored and maintained in a
sanitary condition; that adequate toilet and handvl~ashing
facilities be provided for use of employees; that the
building and premises be maintained in a clean and sani-
tary condition and free of all vermin, filth and refuse;
and that a safe water supply and sanitary sewage disposal
system be provided.
Section 6: PenaltieS., Any person violating
any of the provisions of this Ordinance shall be deem
guilty of a misdemeanor, and upon conviction thereof shall
be punished by a fine not exceeding Five H~ndred Dollars
($500) or by imprisonment for a period not exceeding thirty
~30) days or by both fine and imprisonment
~ Ordinance 11, 12, 72 and.127 of the
City of Tustin are hereby repealed.
PASSED AND ADOPTE~D at' a regular meeting of the
City Council of the City of ~stin, held on the 15th day of April, 1963.

is five; that the above and foregoing Ordinance ~;as
duly and regularly introduced and read at the regular
meeting of the City Council held on the 1st day of
April, 1963, and was given its second reading and
duly passed and adopted at a regular meeting held on
the 15th day of April, 1963, by the following vote:
