RESOLUTION NO. 769 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, GRANTING A VARIANCE ON APPLICATION NO. V. 65-154 OF HALVERSON. The Planning Commission of the City of Tustin, California, hereby resolves as follows:' Section 1: The Planning Commission finds and determines as follows A) That a proper application (No. V. 65-1.54) was filed by Halverson to permit reduction of minimum lot width, minimum lot area, m~nlmum rear yard on the ~ronerty in the 100-E-4 zone and located on the South side of Santa Clara Avenue, 140 feet East of Laurinda Way, Tustln, California, more ~articularly described as follows: Parcel 1. The Westerly 3 acres of that portion of lot 9 in block "B" of the Chapman Tract, in the County of Orange, State of California, as surveyed by Frank LeCouvreur in December 1870 and. recorded in book 102 page 15 of'. Miscellaneous Ma~s, in the office of the County Recorder of said County, described as follows: BeglnninE at a point on the easterly line of said lot noPtherly 979.35 feet from the southeast corner of said lot; thence West 764.~9 feet parallel with the South line of said lot to the West line of said lot; thence North 3~.52 feet along said West llne to the northwest corner of said lot; thence easterly 785.65 feet along the North line of said lot to the northeast corner of said lot; thence southerly ~4.92 feet alon.~ the easterly llne of said lot to the point of beginning. EXCEPT that ~ortlon thereof lying westerly of the following described line: Beginning at a point on the North line of said lot, South 89° 53' 30" East 275.00 feet from the northwest corner of said lot, said point bein~ the northeast corner of the land. described in the deed to Appraisers Investments Corp., recorded August 20, 1963, in Book 6683 page 224 of Official Records of said Orange County: thence South 0© 01' 00" East 180.00 feet along the easterly line of said land; thence South 7o .58' 04" East 166.06 feet to the South liue of the land described in the deed to John C. Steffens and wife, recorded July 19, 1944 in book 1265 page 164 of said Official ~qecords. Said land is included wit in the area shown on a map filed in book 66 page 22 of Record of Surveys, in the office of the County Recorder of said County. Parcel 2 That portion of lot 9 in Block "B" of the Chapman Tract, in the LC~utvy eOufrO~n~~ ~te of California, as surveyed by Frank r e r 1870, and recorded in Book 102 pa.6e 15 of Miscellaneous Maps, in the off~ce of the County Recorder of said County, described as follows:' Beginning at the northwesterly corner of the land described in the deed to Elwin~ S. Nelson, recorded December 12, 1956 in book 3?40 page 327 of Official Records: thence South 89© 53' 55" East 28.00 feet along the northerly line of said land; thence South 0© 01' 40" East 3~.52 feet to the southerly line of said land; thence North 89© 53' 55" West 28.00 feet to the southwesterly corner of sa~d land; thenc~ North 0© 01' 40" West 3~.52 feet to the point of beginning. Said land is included within the area shown on a map filed in book 66 page 22 of Record of Surveys, i~n the office of the County Recorder of said County. B) That a public hearing was regul~rly called, noticed and held on said application. C) That special geographical factors make the restrictions of the zone in which said property ~s located more restrictive upon the subject ~roperty than they are upon other properties in the same zone and neighborhood. D) That strict adherence to the restrictions of said zone would create a hardship to the owner of said ~roperty. E) That ~rant~n~ said variance would not be detrimental to adjacent properties and uses and would be harmonious with the neighborhood and the general ~lan of the City of Tustin and should be granted. Section 2: The variance, as applied for, is hereby ~ranted to ~ermit reduced lot width, lot area, and rear yard, each and all as shown on the plans on file. PASSED AND ADOPTED at a regular meeting of the Planning Commission of the City of Tustin held on the 8th day of March, 1965.
