AN ORDINANCE OF THE CITY COUNCIL 0F THE
CITY 0F TUSTIN, CALIFORNIA, CHANGING
PROPERTY TO THE R-3 ZONE ON APPLICATION
N0. Z.C. 63-114 ON APPLICATION 0P MULLAN-
EY.
The City Council of the City of Tustin,
California does ordain as follows~.
Secti.0n ..1.:.. That a proper application (no.
Z.C. 63-114) was filed on behalf of C.M. MULLAN~ for
change to the R-3 zone of the property described as
follows:
Parcel:~ 1: All that certain real ~roperty
situated in the Rancho Santiago De Santa
Ana, County of Orange, State of CalifOrnia,
described as follows;
Commencing at a stake 16.40 chains East of
a boulder stone that ~arks the Northwest
corner of lands conveyed by Silas Ritchey
to G.G, Godfrey on October 20,188i, and
running thence South 12~- chains to a stake;
thence East 4 chains to a stake; thence
North 12~.- chains to a stake; thence West
4 chain to the point of~ beginning.
EXCEPTING THEREFROM the North 20 feet
thereof las conveyed by G.G. Godfrey et al
to the Board of Supervisors in 1881, for
road purposes, and in other documents of
record.
Parcel 2: That portion of the land allot-
ted to F.W. Koll in Decree of Partition of
the Rancho Santiago de Santa Ana, recorded
in Book "B" of Judgments of the 17th JudiS~
ial District Court of California, in the
City of Tustin, County of Orange, State of
California, described as follows:
beginning at a point North 89o30' East
502.97 feet from the northeast corner of

the land described in the deed to Chester
H. Kenyon and wife recorded in book 190 page
341 of Deeds; thence North 89°30, East 472.
23 feet parallel with the North line of said
F.W. Moll allotment to the southeasterly line
of said F.W. Koll allotment thence South 39°
47' West 300.60 feet along said parallel line
to the most easterly corner of the land con-
veyed to Charles A. Patton and wife by deed
recorded September 29, 1942 in book 1162 page
233, Official Records; thence North 51° West
359-97 feet to the point of beginning.
EXCEPTING THEEFROM THE Southwesterly 85.00
feet thereof measured along the Southeasterly
line as reserved in the deed from Earl A. Shaf-
fer et ux t~ Gifford B. Aarvig et us, record-
ed March 28, 1945, in book 13-1.3, page 29,
Official Records.
Parcel 3: The right to install, use and main-
tain a pipe line along the Northerly 3 feet
of the 85 foot parcel of land adjoining the
land described as Parcel 2., above, on the
Southwest, as conveyed to Gifford B. Aarvig
et ux by deed recorded March 28, 1945, in
book 1313, page 29, Official Records.
S:ect.io.n..2: That the Planning Commission
duly called, noticed and held a public hearing on said
application, and recommended the change of zone of said
property to the R-3 zone.
SeC.tio. n .3: The City Council finds and deter-
mines that it is in the public interest and in keeping
with the general city plan to change said zone to the
R-3 zone.
section 4: The aforedescribed property is
hereby changed to the R-3 zone, except for the property
abutting on McFadden Street which is hereby changed to
the R-2 zone, subject to the condition that said pro-

perty abutting on McFadden Street which is hereby
changed to the R-2 zone, subject to the conduition
that said property abutting McFadden Street shall
be restricted and limited to one-story buildings,
and subject to the condition that through hcbess
from Newport Avenue to McFadden Stk~e'et be restricted
785 feet South of McFadden Street' except for pure
poses of a fire road. The zoning map of the City
is hereby so amended.
PASSED AND ADOPTED at a regular meeting of
the City Council of the City of Tustin, he:ld on the
15th day of April, 1963. MAYOR

ed at a re~lar meeti~ held on the 15th day of April,
1963 by the following vote:
