HomeMy WebLinkAboutPC RES 758RESOLUTION NO. 758 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, GRANTING A CONDITIONAL USE PERMIT ON APPLICATION NO. U.P. 64-182 OF RALPHS INDUSTRIES TO PERMIT THE CONSTRUCTION OF A SHOPPING CENTER ON FIVE ACRES OR MORE ON PROPERTY ZONED 100-CIP-10,000. The Planning Commission o£ the City of Tustin, California, resolves as follows: Section 1: The Plannlng Commission finds 8nd determines that a proper appllc--~tion (No. U.P. 64-182) was filed on behalf of Ralphs Industries to permit the construction of a shopping center on approximately 6 acres of property located at the North side of l?th and 165 West of Yorba end described as follows: Ralph's Market - Tust~n, California That portion of the East half of Lot 1~ in Block B of the Map of the A.B. Chapman Tract as surveye~ by Frank LeCouvreur in 1870, in the City of Tust[n, County of Orange, State of Callfornia, as shown on map recorded in Book 102, Page 1~ of Mlscellaneous Maps in the office of the County Recorder of said County, described as follows:' The Westerly 4~.00 feet, meas~red at right .~ngles to the Westerly line of the East half of Lot 1~, of the Southerly 670.00 feet, measured at right angles to the Southerly line of said Lot 1~. EXCEPT therefrom the Southerly ~0.00 feet. ALSO EXCEPT therefrom thst portion of the East half of said Lot 1~, described as follows: 8eginnin~ at a point on the South 1.The of said Lot 1~ that bears North 89° 07' ~?" Section 3: The Planning Commission finds and determines that said shopping center would not be detrimental to the surrounding area or general plan of the City of Tustin, and should be granted. Section 4: Said Co'nditional Use Permit, as applied for, and according to plans submitted (Exhibits "A" snd "B" on file in the office of the City Clerk) is hereby o~ranted subject to the following conditions: 1. That a (6) foot masonry wall be constructed on the property line between the proposed development and the adjacent PD 3500 zone, except that portion of the front setback distance, which shall be three (3) feet. 2. That the building on the east side of the property be set back ten (10) feet as required by the Zoning Ordinance. 3. That landscaping follow those plans as submitted on Exhibit "B". 4. That the landscapinE be maintained and sprinkler systems be installed as indicated on the landscaping plans. 5. That the applicant comply with all conditions set forth by the Engineering Department and Fire Department, as follows: a. Street improvements be installed to the satisfaction of the City Engineer. bo Street lights be installed as required by the Public Works Department. .c. Hydrants be plsced to the requirements of the Fire Department. d. That all fire protection provisions meet the standards set forth by the Tustin Fire Department. 6. That the Planning Director review the proposed Ralphs free standing sign facing Seventeenth Street. PASSED AND ADOPTED at a regular meeting of the Planning Commission of the City of Tustin, held on the 28th day of December, 1964.
