HomeMy WebLinkAboutPC RES 757RESOLUTION NO. 757 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, RECOMMENDING A ZONE CHANGE FROM E-4 TO PR ZONE UPON THE APPLICATION NO. Z. C. 64-140 OF THE TUSTIN ELEMENTARY SCHOOL DISTRICT. The Planning Commission of the City of Tustin, California, does resolve as follows: Section 1: The Planning Commission finds and determines that a proper application (No. Z.C. 64-140) was filed by the Tustin Elementary School District for change of zone for the property at the Northwest corner of Fourth and "B" Streets, and the Southwest corner of Fourth Street and extension of "B" Street, and more particularly described as follows: PARCEL A PROPERTY DESCRIPTION FOR TUSTIN ELEMEi'~TARY SCHOOL DISTRICT That portion of Land in the County of Orange, State of California, described as follows: Commencing at a point on the centerline of Prospect Avenue distant ~ortherly ?84.39 feet from the southeast corner of the first tract allotted to Teodocia Yorba by decree in the partition of the Rancho Santiago de Santa Aha, in the suit of Abel Stearns, et. al,. v.s. Leonardo Cora et.al., said southeast corner bein~ marked by a Bolt at the centerline intersection of Prospect Avenue and First Street; thence S 89°37'54'' W 1219.96 feet to a point in the west line of said tract allotted to Teodocia Yorba distant alon~% said westerly line N 0°10'30" W 781.3~ feet from the southwest corner of said tract, said point being the TRUE POINT OF BEGINNING of the oarcel of land to be described herein; thence along said west line N 0°10'30'' W 112.75 feet tO a point on the southerly .line of the varcel of land described in an easement deed to the County of Orang%e recorded August 9, 1962, in Book 620? pa~e 885 of Official Records in. the office of the County Recorder of Orange County California, said southerly line being a nontan,=~nt. ~.~. curve concave southerly and having a radius of 1150.00 feet. EXCEPTING THEREFROM: that portion described as follows: Beginning at the intersection of said northerly line of parcel of land conveyed to the County of Or~nse with the easterly line of the above described parcel; thence northerly alon~ said easterly line 20.00 feet; thence southwesterly in a direct line to a point on s8id northerly line of parcel conveyed to the County of Orange distant westerly 20.00 feet from the point of beginning, thence e~sterly 20.00 feet to the point of beginning. .~ection 2~: The Planning Commission duly called, noticed and held a public hearlng on said application. Section 3: The Planning Commission finds and determines that the above recommended rezoning would be in the best interests of the subject property, adjacent ~roperty ~nd uses and the general plan of the City of Tustin. Section 4: The herein described property is hereby rezoned to PR (Professional Residential), subject to the following condit ion: That the property have a ten (10) foot setback to conform with existing setbacks along Fourth Street PASSED AND ADOPTED at a regul_~r meeting of the Planning Commission, held on the 14th day of December, 1964.
