HomeMy WebLinkAboutPC RES 748RESOLUTION NO. 748 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, A VARIANCE ON APPLICATION NO. 64-150 OF HARRIS & DENNER. The Planning Commission of the City of Tustin, C~ =llfornia, resolves as follows: SECTION 1: The Planning Commission finds and determines that a proper application (No. 6a-!~0) was filed for the waiver of the rear yard setback requirement of five (5) feet to zero feet on property locate~ at 14172 Newport Avenue an~ more particularly describe~ as follows: That oortiom of Lot 33 in Block 11 of Irvine Subdivision in the City of Tustin, County of Orange, State of California, as per map recorded in book 1 page 88 of Miscellaneous Maps, in the office of the county recorder of s.sid County, described as follows: Beginnin:~ at a point in the northwesterly line of Tract No. 1863, as shown on a map thereof recorded in book 54 page 20 of Miscellaneous Maps, records of said Oran~e County, distant thereon North ~9© 50' 30" .East 385.70 feet from the intersection of the Southwesterly prolon~at[on of said northwesterly l~ne with the center line of the street, 66.00 feet in width, now known as Mitchell Avenue, adjoining said Tract No. 1863, on the southwest; the~ce North 50° 09' 30" West 136.00 feet, more or less, to the northwesterly line of said Lot thence 12~.o0 feet to the we~terly corner of Parcel 1 of the land conveyed to Phil]..ip A. Segrais and wife, by deed record~d September 28, book xS~ page 507, Official Records; thence South 50~ 09~ 30" East along the southwesterly line of Parcel 1 of said land conveyed to Segrais, 136.00 feet, more or less, to the most northerly corner of Lot ? of said Tract No. 1863; thence South 39° 50' ~0" West along the northweaterly line of said tract, 12~.00 feet to the point of beginnin~. SECTION 2: The Planning Commission duly called, noticed and held a public hearing on said application. SECTION ~: The Planning Commission finds and determine~~ o that because of t~,.., special circumstances of the subject property, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone cl assification. SECTION 4: A variance to waive the rear yard setback requirement of· five (5) feet to zero feet is hereby granted, subject to the following conditions: 1. Parking arrangements and all other City requirements as aoproved by the Planning Staff. 2. Provisions for trees as aoproved by the Parks and Recreation Commission. PASSED AND ADOPTED at a regular meet lng of the Planning Commission, held on the 13th day of October, 1964.
