HomeMy WebLinkAboutPC RES 691 RESOLUTION NO. 691 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, DENYING A CONDITIONAL USE PERMIT ON APPLICATION NO. U. P. 63-153 OF COSTA PACIFICA. The Planning Commission of the City of Tustin, California, does resolve as follows: Section l: An application (No. U.P. 63-153 was filed by Costa Pacifica for approval of development plans of thirty-eight unit garden apartments on the property described as follows: That portion of a resubdivision of Rice's addition to Tustin, in the County of Orange, State of California, as per map recorded in Book I Page 47 of Miscellaneous Record Maps, in the office of the county recorder of said county, described as follows: Beginning at the intersection of the center lines of First Street and Prospect Avenue, and running thence North 0°16' West along said center line of Prospect Avenue, 404.96 feet; thence, North 89o45' East, parallel with said center line of First Street, 672.53 feet to the Northeast corner of the land conveyed to A. B. McMahan and wife, by deed recorded December 20, 1941 in Book lll9, Page 421, Official Records, thence South along the East line of said land conveyed to McMahan, 404.96_feet to said center line of First Street;' thence South 89045' West 672.53 feet to the point of beginning; EXCEPT therefrom that portion described as follows: Beginning at the intersection of center lines of First Street and Prospect Avenue, and running thence North 0°16' West along said center line of ProSpect Avenue, 190.00 feet; thence North 89° 45' 00" East, parallel with the center line of First Street, 175.00 feet; thence South parallel with said center line of Prospect Avenue, 190.00 ~eet to said center line of First Street; thence South 89v 45' 00" West 175.00 feet to the point of beginning~ JUSTIFICATION: To the north of the property in question, 40 single family residences have been recently constructed under the County's Planned Development Ordinance. To the east of us an apart- ment development is under construction. This parcel is zoned R-4. We feel that our garden apartment project would provide an ideal buffer between the single family planned development immediately to the north and the eventual commercial development of our property fronting on First Street. We feel that a development of the nature we propose would be in keeping with the zoning and the use of theproperty to the east. Section 2: The Planning Commission duly called, noticed and held a public hearing on said application on November 25, 1963. Section ~: The Planning Commission finds and determines that the proposed development would be detrimental to adjacent property and adjoining uses, and will not be in harmony with the general plan of the City. Section 4: A Conditional Use Permit, as applied for, is hereby denied. PASSED AND ADOPTED at a regular meeting of the Planning Commission of the City of Tustin, California, held on the 26th day of November, 1963.
