HomeMy WebLinkAboutPC RES 678 RESOLUTION NO. 678 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, GRANTING A VARIANCE ON APPLICATION NO. V 63-133, OF DAVIS The Planning Commission of the City of Tustin does resolve as follows: Section 1: That a proper application for variance (V. 63-133) was filed by DAVIS to permit construction of a drive-in restaurant and dining room in the C-1 district, for the property described as follows: That portion of Lot 9 of Vanderlip and Rowan Tract, in the City of Tustin, County of Orange, State of California, as per map recorded in Book 5, Page 160 of Miscellaneous Records, in the office of the County Recorder of Los Angeles County, California, described as follows: Parcel 1: Commencing at the Northwest corner of the land conveyed to Roy W. Waer, et al., by deed recorded July 7, 1959^ in Book 4788, Page 460 of Official Records; thence North 89v53'09'' East, 198.56 feet along the North line of the land conveyed by said deed; thence South 0°12'21'' East, 21.22 feet paralled with the center line of Holt Avenue (shown as an 80.00 foot ro~d on said map) to the true point of beginning; thence North 89v53'09'' EastA~0.00 feet, parallel with said Northerly line; thence South 0°12'21'' East,~ Rarallel with said center line, 150.00 feet; thence South 89v53'09'' West, ~arallel with said Northerly line, 50.00 feet; thence North 0°12'21'' West, o parallel with said center line, 87.00 feet; thence North 17 24'52" East, 66.07 feet to the True Point of Beginning. Parcel 2: An Easement for non-exclusive ingress and egress over the land described as follows: Commencing at the Northwest corner of the land conveyed to Roy W. Waer, et al, by deed recorded July 7, 1959^ in Book 4788 Page 460 of Official Re. cords; thence North 89v53'09'' East, 198.36 feet along the North line of the land conveyed by said deed, thence South 0°12'21'' East, 2122 feet parallel with the center line of Holt Avenue (shown as an 80.00 foot road onAsaid map) to the true point of beginning; thence South 17°24'52'' West, 66.07 feet; thence North 0~12'21'' West, parallel with said center line 63.00 feet; thence North 89 53'09" East, parallel with said Northerly line, 20.00 feet to the True Point of Beginning. Section 2: That a public hearing was duly called, noticed and held on said application, on October 14, 1963. Section 3: The Planning Commission finds and deter- mines that because of unusual circumstances applicable to said premises the limitations of the Zone in which said property is located are more burdensome upon the subject property than upon other properties in the same Zone and area; that the granting of said variance will not be detrimental to the subject property or to surrounding properties and their uses; and that said use will be in harmony with the general plan of the City of Tustin. Section 4: The variance as applied for is hereby granted, for the construction, operation and use of a drive-in restaurant and dining room, with a seating capacity of twenty-four (24) persons, in the C-1 Zone, subject to the following terms and conditions: (a) The applicant shall dedicate Fourth Street to a width of 50 feet from the centerline thereof and improve said right of way with concrete curbs, gutters, sidewalk, drive approaches and paving, all meeting the approval of the City Engineer; (b) The parking area shall be paved and parking spaces shall be lined thereon as indicated on the plot plan. (c) If the property is drained directly into the Orange County Flood Control Channel, the method shall be approved by the City Engineer and the Chief Engineer of the Orange County Flood Control District. PASSED AND ADOPTED at a regular meeting of the Planning Commission of the City of Tustin, California, held on the 14th day of October, 1963.
