HomeMy WebLinkAboutPC RES 672 RESOLUTION NO. 672 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, GRANTING A VARIANCE ON APPLICATION NO. V. 63-132 OF UNION OIL COMPANY. The Planning Commission of the City of Tustin, California, resolves as follows: 1. The Planning Commission finds and determines that a proper application (No. V 63-132) was filed on behalf of UNION OIL COMPANY for a variance for a pump island canopy, sign and area light to project into the setback area, for the property described as follows: The west 145.90 feet of the east 811.80 feet of the south 195.00 feet of Lot 'L' of the Stafford and Tustin Tract, in the City of Tustin, County of Orange, State of California, as per map recorded in Book 2 pages 618 and 619 of Miscellan- eous records, in the office of the County Recorder of Los Angeles County, California. Except that portion thereof lying southerly of the following describedlines: Beginning at the southeast corner of the west 105.90 feet of said land; thence westerly 100.00 feet along the South line of said land to the true point of beginning; thence northeasterly in a direct line to a point on the East line of said West 105.90 feet, northerly 16.00 feet from said southeast corner,_thence South 89 43' 50" East 20.00 feet; thence North 45° 28' 36" east 28.39 feet to the east line of said land. ALSO EXCEPT therefrom all minerals, oils, gases and other hydro-carbons by whatsoever name know, that may be within or under the parcel of land described in the deed from State of California, recorded April 19, 1962, in Book 6080 Page 894, Official Records, without however the right to drill, dig or mine through the surface thereof. 2. The Planning Commission duly called, noticed and held a public hearing on said application on September 10, 1963. 3. The Planning Commission finds and determines that said variance as applied for should be, and the same hereby is granted, subject to the following conditions: (a) That the applicant shall dedicate and improve McFadden Street toits ultimate width of forty feet (40') north of th~ centerline, to the satisfaction of the City Engineer. (b) All signs shall comply with the Tustin Sign Code. (c) The trash area shall be screened from adjacent property. (d) All lighting shall be shielded so as to confine direct rays to the subject property. (e) Ail buildings shall be in the location and as indicated on the plot plan. (f) A concrete block wall shall be installed along the north and west property lines of the subject property to a height of six feet (6') except within the front yard setback area~ and there to be to a height of three feet (3'). (g) That shrubbery and/or trees be installed and maintained along the side of the property adjacent to Tustin Village Way, to a plan approved by the Architectural Committee. (h) The tire display and/or storage rack or structure shown on the plot plan shall be relocated to a location approved by the architectural committee.
