A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, GRANTING A CONDITIONAL
USE PERMIT ON APPLICATION NO. U.P. 63-141 of
TUSTIN ELEMENTARY SCHOOL DISTRICT.
The Planning Commission of the City of Tustin,
California, does resolve as follows:
Section 1: The Planning Commission finds and deter-
mines that a proper application (No. U.P. 63-141) was filed on
behalf of TUSTIN ELEMENTARY SCHOOL DISTRICT for a Conditional
Use Permit for an elementary school on the property described
as follows:
PARCEL 1: The westerly 180.00 feet of the following
described parcel: Beginning at a point in the center line
of~~ Prospect Avenue 784.39 feet North from the Southeast
corner of the first tract allotted to Teodocia Yorba by
decree in the partition of the Rancho Santiago de Santa
Ana, in the suib of Abel Sterns et al. vs. Leonardo Cota
etal., the said Southeast corner being marked by a bolt
at the intersection of the 8enter line of Prospect Ave-
nue with the center line of First Street; running thence
from said point of beginning West 1219.96 feet to a point
in the West line of said tract allotted to Teodocia
Yorba, which is 781.34~ feet North from the Southwest
corner of said tract; running thence North along the
West line of said tract, 717.66 feet to a point; thence
East 1219.01 feet to a point in the center line of Pros-
pect Avenue, which is 720.46 feet North of the point
of beginning; thence South 720.46 feet to the point of
beginning; excepting that portion lying South of the Nor-
therly boundary of Fourth Street Right of Way.
NOTE: Said land, with other land, is described on
the County Tax Assessment Roll for the fiscal year 1959-
60 as A.P.No. 62-180-3
PARCEL 2: That protion of the Westerly 180.00 feet
of the following described parcel lying Southerly of the
Easterly prolongation of the North line of Lot 6 of the
Tomas Yorba Tract, as shown on a Record of Survey Map,
recorded in book 1, page 33, Records of Surveys, in the

Office of the County Recorder of said Orange County,
described as follows:
Beginning at a point in the center line of Prospect
Avenue, 1504.85 feet North of the Southeast corner of the
first tractS, allotted to Teodocia Yorba by dcree in the
partition of the Rancho de Santa Ana, in the suit of
Abel Sterns and others vs. Leonardo Cota and others,
the said Southeast corner being marked by a bolt at the
intersection of the center line of Prospect Avenue with
the center line of First Street; thence North along
the center line of Prospect Avenue ?2?.?9 feet to the
corner of land formerly owned by B.F. Mazon; thence
West 1218.05 feet to the land of Tomas Yroba being the
West line of said tract allotted to Teodo¢ia Yorba;
thence South ?24.95 feet along said line to a point
1499 feet North of the center line of said First Street,
said point being the Northwest corner of the land be-
longing to Stella May Nau, as established in agreement
between said Stella May Nau and W.J. Cheney and wife
dated August 4, 1925, and recorded October 17, 1925,
in bOok 612, page 145, Deeds, in the office of the Co-
unty Recorder of said Orange County; thence East 1219.01
feet along the North line thereof to the point of beginn-
ing.
NOTE: Said land, with other land, is described on
the County Tax Assessment Roll for the fiscal year 1959-
60 as A.P. No. 62-180-02.
PARCEL 3: The Easterly 480.00 feet of~Lot 7 of the
Tomas Yorba Tract, as shown on a Record of Survey Map,
recorded in book 1, page 33, Record of Surveys, in the
office of the County Recorder of said Orange County;
Legal Description, North "B" Street School Site
EXCEPTING therefrom all mineral and oil rights in or
under said land lying below a depth of 500 feet from the
surface thereof, but without the right of entry upon the
surface of said land and to a depth of 500 feet there-
from, as reserved in the deed from Roy D. Lewis and others
filed for record November 10, 1959, in the office of the
County
Recorder of said Orange County.
NOTE' Said land is described en the County Tax Assessment
Roll for the fiscal year 1959-60 as A.P. No. 62-160-9.
PARCEL 4: The Easterly 480.00 feet of Lot 6 of the Tomas
Yorba Tract, as shown on a Record of Survey Map, recorded
in Book 1, page 33, 'Record of Surveys, in the office of
the County Recorder of said Orange County;
EXCEPTING all oil and mineral rights below a depth of 500
feet from the surface of said land, but without right of
ingress or egre.ss.~or~'.~entry on said land, as excepted in the
deed from H.E. Balmer and wife, recorded October 12, 1959.
NOTE' Said land, with other land, is described on the County
Tax Assessment Roll for the fiscal year 1958-59 as A.P. No.
62-160-8.
Section 2: The Planning Commission duly called,
noticed and held a public hearing on said application on
June 10, 1963, and on June 24, 1963.
Section 3' The Planning Commission finds and
determines that the proposed use will not be detrimental to
the health, safety, morals, comfort or general welfore of the
persons residing in the area, nor injurious or detrimental
to property or improvements in the neighborhood or the
general welfare, and is in keeping with the general plan
of the City.
Section 4' The Conditional use permit, as
applied for, is hereby gra. nted, subject to the following
conditions'
1) The School District shall dedicate to the
City of Tustin, and improve the right-of-way for "B"
Street, within said City, in a manner meeting the approv-
al of the City Engineer;
2) The School District shall provide one (1)
additional fire hydrant approximately three hundred (300)
feet to the south of the proposed hydrant on the west
side of "B" Street, meeting.the approval of the Fire Chief;
3) Ail parking spaces shall be striped, meeting
the standards of the City of Tustin;
4) The site shall be fenced as indicated on the
plot plan.
5) The location of all buildings and structures
shall be as indicated on the plot plan.
PASSED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Tustin, California,
held on the 24th day of June, 1963.

of the Planning Commission of the City of Tustin, California;
that the foregoing Resolution was duly passed and adopted at
a regular meeting of the Planning Commission, held on the
24th day of June, 1963.
