A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TUSTIN, CALIFORNIA, GRANTING
A CONDITIONAL USE PERMIT ON APPLICATION
U. P. 63-134 FILED ON BEHALF OF FREDERICKS
DEVELOPMENT.
The Planning Commission Of the City of Tus-
tin, California, resolves as follows'
Sectiqn 1: The Planning CommisSion finds
and determines that a proper application for a Con-
ditional Use Permit (#U.P. 63-134) was filed on be-
half of Fredericks Development for the property as
follows:
Parcel A: That protion of the Southwest quar-
ter of Lot "M" of Stafford and Tustin Tract,
as shown on a map recorded on book 2, pages
618 and 619 of Miscellaneous Records of Los
Angeles County, California, described as
follows:
Beginning at a ~oint on a line parallel with
and distant Easterly of the centerline of
Tustiu Avenue 391.60 feet ( measured along
the centerline of McFadden Street ). distant
thereon Northerly 357.00 feet from said cen-
terlime of McFadden thence continuing North-
erly along said parallel line, 203.20 feet
to the North Line of said Southwest quarter;
thence Easterly along said North line to a line
parallel wit~ and distant 354.40 feet Easterly
of said centerline of Tu~tin Avenue (measur-
ed along said centerline of McFadden Street);
thence Southerly along said parallel line,
203.20 feet; thence Westerly, parallel with
said North line of the Southwest quarter to
the true point of beginning.
Parcel B: That portion of the Southwest quar-
ter of Lot "M" of Stafford and Tustin Tract

as shown on~a map recorded in book 2, pages
618 and 619 of Miscellaneous Records of Los
Angeles County, California, described as foll-
ows:
Beginning at a point on a line parallel with
and distant 391.60 feet Easterly of the cen-
terline of Tustln Avenue (measured along the
centerline of McFadden Street)~ distant there-
on North 0° 41~' 01" East, 153.47 feet from
the centerline of said McFadden Street; thence
continuing North 0° 41' 01" East, to an inter-
section with a line parallel with and distant
203.20 feet Southerly of the North line of
said Southwest quarter; thence Easterly along
said parallel line to a line parallel with
and distant 554.40 feet Easterly of said cen-
terline of Tustin Avenue (measured along said
centerline of McFadden); thence Southerly along
said line South 0° 41' 01" West, 102.37 feet;
thence South 45° 18' 59" West, 28.28 feet;
thence North 69° 16' 59" West, 142.79 feet to
the true point of beginning.
Parcel C: The Southwest quarter of Lot "M" of
Stafford and Tu~tin Tract, as shown on a map
recorded in book 2, pages 618 and 619 of Mis-
cellaneous Records of Los Angeles County,
California.
Excepting therefrom the following;
Beginning at the intersection of the center-
line of Newport County Road (now Tustin Avenue)
as shown on said map of Stafford and Tu~tin
Tract, with the South line of said Lot "M" ex-
tended, running thence East along the South
line of said Lot "M" 391'~6 feet; thence North
parallel to the West line of said Lot "M" to
a point in the North line of the Southwest
quarter of said Lot "M"; thence West along
said North line 391~.6 feet to a point in the
centerline of said Newport County Road; th-
ence South along said centerline to the point
of beginning.
Also excepting therefrom the following'
Beginning at the intersection of the East
line of the ~,Iest 391.60 feet of said Lot
(measured from the center line of Newport
County Road, now known as Tu~stin Avenue),
with the South line of said Lot (being also
the l~orth line of McFadden Street); thence
along said East line, North 0° 41' 01" East,
133.47 feet; thence South 89° 18' 59" East,
142.79 feet; thence. North 45° 18' 59" feet
to a line parallel with and distant Easter-
ly 554.40 feet, measured along the center-
line of said McFadden Str~et, from said cen-
terline of Tustin Avenue; thence along said
parallel line, North 0° 41' 01" East, 335.57
feet tO the North line of said Southwest
ouarter; thence along said North line, South
89° 30' 59" East, 60.13 feet to a line par-
allel with and distant Easterly 60.00 feet,
measured a.t right angles, from. the afore-
mentioned parallel line;, thence along said
last described parallel line, South 0° 41'
01" West, 498.91 feet; thence South 44° 30'
16" East, 28.19 feet to a line parallel with
and Distant Northerly 40.00 feet, measured
at right angles, from said centerline of
McFadden Street; thence along said parallel
line, South 89o 41' 32" East, 90.34 feet;
thence South 78° 56' 05" East, 433"25 feet
to the point of Beginning.
Also excepting therefrom the protion contain-

ed in Parcel A and B.
Section 2: The Planning Commission of the
City of Tustin duly called, noticed and held a public
hearing on the proposed Conditional Use Permit on
March 11, 1963, at 7:30 P.M., in the Council Chambers
of the City of Tustin, 145 West Third Street, Tustin,
California, all in accordance with Ordinance No. 157,
as amended, of the City of ~stin. Said hearing was
duly held.
Sectio~ ~: The Planning Commission of the
City of Tustin finds and determines that the grant-
ing of said Conditional Use Permit as applied for is
in the public interest and is in conformity with the
intent of the P.D. zone, and preliminary approval of
said plans and application is hereby granted subject
to the following conditions:
1) conformity to the applicable building
set back requirements.
2) conformity to the recommendations of
the Fire Ch~f.
3) conformity to the recommendations of
the City Engineer.
4) conformity to the recommendations of
Albert Nelson of the Land Use Division.
PASSED AND ADOPTED at a regular meeting of
the Planning Commission of the City of Tustin, Calif-
ornia, held on the 11th day of March, 1963.
