MULLANEY The Planning Commission of the City of Tustin, California does hereby~ resolve as follows: Secti0D .~: The Planning Commission finds and determines that a proper application, (No.ZC 63- 114) was filed for rezoning to R-3 the property of C. M. Mullaney, located at Newport Boulevard and McFadden Street, and more particularly described as: Parcel 1: All that certain real property sit- uated in the Rancho Santiago De Santa Aha, County of Orange, State of California, described as follows: Commencing at a stake 16140 chains East of a boulder stone that marks the Northwest corner of lands conveyed by Silas Richey to G.G. Godfrey on October 20, 1881, and running thence South 12-½ chains to a stake; thence East 4 chains to a stake; thence North 12-~? chains to a stake; thence West 4 chains to the point of beginning. EXCEPTING THEP~FROM the North 20' feet thereof as conveyed by G.G. Godfrey et al to the Board of Super- visors in 1881, for road purposes, and in other docu- ments of record. Parcel 2: That portion of the land allotted to P.W. Y~oll in Decree of Partition of the Rancho San- tiago de Santa Aha, recorded in Book "B" of Judgement of the 17th Judicial District Court of California, in the City of Tustin, County of Orange, State of California, described as follows: Beginning at a point North 89°30' East 502.97 feet from the northeast corner of the land described in the deed to Chester H. Kenyon and wife recorded in book 190 page 341 of Deeds; thence North 89°30' East 472.23 feet paral]_el With the Eorth line of said F.W. Koll 252 allotment to the southeasterly line of said F.W. Koll allotment thence South 39°47' West 300.60 feet along said parallel line to the most easterly corner of the land conveyed to Charles A. Patton and wife by deed re- corded September 29, 1942 in book 1162 page 233, Official Records; thence North 51o West 359.97 feet to the point of beginning. EXCEPTING THEREF~:OM the Southwesterly 85.00 feet thereof measured along the Southeasterly line as reserved in the deed from Earl A. Shaffer et u× to Gifford B. AarVig et ux, recorded March 28, 1945, in Book 1313, page 29 Official Records. Parcel 3' The right to install, use and main- tain a pipe line along the Northerly 3 feet of the 85 foot parcel of land adjoining the land described as Par- cel 2, above, on the Southwest, as conveyed to Gifford B. Aarvig et ux by deed recorded March 28, 1945, in book 1313, page 29, Official Records. Section 2: The Planning Commission duly held a regularly called and noticed public~ hearing on said application on February 25th, 1963, at 7:30 P.M. in the Council Chambers of the City Hall, Tustin, California. At said hearing no one spoke for or against said appli- cation. Section 3~: The Planning Commission finds and determines that it is in the best interests of the City of Tustin, the subject property and the area surrounding, that the subject property be rez0ned to R-3, and recom- mends to the City Council that said Property be changed to the C-1 Zone. PASSED AND ADOP~D at a regular meeting of the Planning Commission of the City of Tustin, held on the 25th day of February, 1963.
