RESOLUTION NO. 560
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TUSTIN, CALIFORNIA, GRANTING A
VARIANCE UPON THE APPLICATION OF pARK LANE
APARTMENT PROJECT AND RESEARCH ASSOCIATES.
The Planning Commission of the City of Tustin,
California, does hereby resolve as follows:
Section l: The Planning Commission of the City
of Tustin, California, finds and determines that a proper ap-
plication for a variance was filed by PARK LANE APARTMENT PROJECT
AND RESEARCH ASSOCIATES for the granting of a variance to allow
the construction of garages on both the front and ~rear halves of
the real property on Blakely Street, City of Tustin, California,
more particularly described as'
PARCEL l: The south one-half of the northwest quarter
of Lot "M" of the Stafford & Tustin Tract, in the Rancho
Santiago de Santa Ana, City of Tustin, as shown on a
map thereof recorded in Book 2, Pages 618 and 619, Mis-
cellaneous Records of Los Angeles County, California,
(measured to the center line of the street on the west);
PARCEL 2' That certain strip of land described as follows:
Beginning 4.09~ chains south of the northwest corner of Lot
"M" of the Stafford & Tustin Tract,in the Rancho Santiago de
Santa Ana, City of Tustin, as shown on a map thereof recorded
in Book 2, Pages 618 and 619, Miscel.laneous Records of Los
Angeles County, California; thence south 4 feet and 4 inches;
thence east 12.21 chains; thence north 4 feet and 4 inches;
thence west 12.21 chains to the point of beginning, (all
measurements being made to, along or from the center line of
the street on the west);
EXCEPTING from said Parcels i and 2 the west 97 feet and the
east 251.47 feet thereof.
PARCEL 3: An easement for street or road purposes over and
across the following described strip of land;
Commencing at a point 4.095 chains south of the northeast
corner of Lot "Mm of the Stafford & Tustin Tract, in the
Rancho Santiago de Santa Ana, City of Tustin, as ehown on
a Map thereof recorded in Book 2, Pages 618 and 619 Mis-
cellaneous records of Los Angeles County, California, and
running thence easterly parallel with the north line of said
Lot ~Mm, 392 feet; thence north 4 feet; thence westerly
parallel with the north line of said Lot "M~, 392 feet;
thence south 4 feet to the point of beginning; as said
easement was described in the Judgment rendered December 2,
1931, in Superior Court of the State of California, in and
for the County of Orange, Case No. 28520.

Section 2: The Planning Commission of the City of Tustin
duly called a public meeting on the.~proposed variance for
May 14, 1962, at 7:30 P.M., in the ~ouncil Chambers in
the City Hall, 145 W. Third Street, Tustin, California, all
in accordance with Ordinance No. 157 of the City of Tustin,
California; said hearing was duly held and at said hearing
no protests to the granting of said variance were heard or
received.
Section $: The Planning Commission of the Cl~ of Tustin
further finds and determines that practical difficulties
and unnecessary hardships will result from strict com-
pliance with Ordinance No. 157, as it relates to said
property, unless said variance be granted; and it is
particularly found and determined that the granting of
Said variance will not constitute a granting of special
privilege inconsistent with the limitations upon other
property in the vicinity and district in which the sub-
ject property is situated; and that because of special
circumstances applicable to the subject property, includ-
ing size, shape, topography, location and surroundings,
the strict application of the Zoning Ordinance will derive
the subject property of privileges enjoyed by other property
in the vicinity and under identical zone~classifications,
in that the proposed development is a deep lot for which
there is planned a multiple family development of garden
apartments, with garages along the side lines of said
property, extending from the front to the back, on either
side. Due to the exceptional circumstances and conditions
applicable to the said property and the intended use there-
of, the granting of the said variance is necessary for the
preservation of a substantial right of the applicant, and
said property cannot otherwise be fully and properly
utilized. The granting of such variance will not be
detrimental to the public welfare or injurious to the
property or improvements in the district where the subject
property is located, due to the type of variance applied
for by the applicant, as set forth in said application,
to which reference is hereby made°
Section.4: The variance applied for is hereby granted,
to allow the installation, construction, maintenance and
use of garages on both halves of said property.
PASSED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Tustin, held on the 14th day of
May, 1962.
