RESOLUTION NO. 559
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TUSTIN, CALIFORNIA, RECOMMENDING
REZONING OF CERTAIN PROPERTY ON APPLICATION
OF LOUIS SCHMETZER
The Planning Commission of the City of Tustin,
California, resolves as follows:
SectiQ~ l: The Planning Commission of the City
of Tustin finds and determines that an application was filed by
LOUIS SCHMETZER for a change of zone for the property at 185 South
Prospect, more particularly described as: The North 155 feet of
Lot "A" of Tract No. 555, as shown on a Map recorded in Book 26,
Page 15, of Miscellaneous Maps, Records of the office of the
Recorder of the County of Orange, State of California, excepting
therefrom the West 137.50 feet of the North 55 feet of said Lot
"A".
Sect. ion 2; The Planning Commission of the
City of Tustin duly called and noticed a public hearing on
said proposed zone change on the 23rd day of April, 1962, at
7:30 P.M., in the Council Chambers in the City Hall, Tustin,
California, all in accordance with Ordinance No. 157 of the City
of Tustin. Said hearing was duly~held, and at said hearing
persons spoke for and against said zone change, including:
Nicholas Barletta, Cai-State Agencies,
217 South D Street
Tustin, California.
Ed Mitchell, c/o Charles Mitchell,
165 South D Street
Tustin, California.
Louis Schmetzer, 185 South Prospect,
Tustin, California.
Section 3: The Planning Commission of the City
of Tustin finds and determines that the applicant has a prior
non-conforming structure anduse in a C-2P Zone, to-wit- a
sheet-metal and air-conditioning assembly business, upon said
property; that the said structure and use was permitted in
the zone existing prior to the adoption of Ordinance No. 157;
that the public interest will be preserved and promoted by
rezoning of part of said property.
Seotion_4: The said Planning Commission recommends
to the City Council of the City of Tustin that the portion of the
subject property described as'
Commencing at a point 40 feet East of the
Southwest corner of the North 155 feet
of Lot "A' Tract No. 555, as per M.M.
Book 26, page 15;
Thence, North 80 feet;
Thence, East 271 feet, plus or minus, to
West line 20-foot alley shown on Tract
No. 3394;
Thence South 80 feet;
Thence West 271 feet, plus or minus,
t° point of beginning,
be rezoned to PM, and that the remainder of said property remain
C-2P.
PASSED AND ADOPTED at a meeting of the Planning
Commission of the City of Tustin, California, held April 23,
1962.
