HomeMy WebLinkAboutPC RES 549 RESOLUTION NO. 549 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, GRANTING A VARIANCE UPON THE APPLICATIIN OF LESTER J. HEHN The Planning Commission of the City of Tustin, California, does resolve as follows: Section l: The Planning Commission of the City of Tustin finds and determines that a proper application for vari- 'ance was filed by LESTER J. HEHN, for the granting of a variance to allow the operation of a custom cabinet and woodworking shop in the property at 155 W. Third Street, Tustin, California. Section 2: The Planning Commission of the City of Tustin duly called a public meeting on the proposed variance for November 20, 1961, at 7~15 o'clock P.M., in the Council Chambers in the City Hall, Tustin, California, all in ac- cordance with Ordinance No. 71 of the City of Tustin, as amended, and said hearing was duly held, and at said meeting no protests to the granting of said variance were heard and received. Section 3: The Planning Commission of the City of Tustin further finds and determines that practical difficulties and unnecessary hardships will result from strict compliance with Ordinance No. 71, as amended, as it relates to said property, unless the variance requested be granted; and par- ticularly it is found and d~termined that there were exceptional circumstances and conditions applicable to the said property and the intended use thereof which do not apply generally to property or classes of use in the same zone; that such vari- ance was necessary for the preservation of a substantial right of the applicant, in that said property could not otherwise be fully and properly utilized; and that the granting of such variance will not be detrimental to public welfare or injurious to the property or improvements in the district where the property is located, due to the type of variance applied for by the applicant, as set forth in the said ap- 118 plication, as .... z~t £o~th tn thn nn~d np?]~n~t~u to which reference is hereby made. Section 4: The variance applied for is hereby granted, for a period of one year, subject to the following conditions: 1. That the electrical wiring in said building be in conformance with the Orange Empire Electrical Code for the in- tended use. 2. That all broken glass be replaced. 3. That such changes be made in said building for fire prevention and safety as are acceptable and deemed necessary by the Fire Chief of the City of Tustin. The aforesaid conditions are to be met prior to use and occupancy.
