HomeMy WebLinkAboutPC RES 545 RESOLUTION NO. 545 A RESOLUTION 'OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, GRANTING A VARIANCE UPON THE APPLICATION OF SIGNAL OIL COMPANY The Planning Commission of the City of Tustin, California, does resolve as follows' ~ect%on l: The Planning Commission of the City of Tustin finds and determines that a proper application for variance was filed by SIGNAL OIL COMPANY, for the granting of a variance to permit construction of a sign 5 feet by 22 feet to extend 5 feet over the right of way of First Street, to be located on the Southwest corner of First Street and 'D" Street, in the City of Tustin, California, more particularly described as Lots 8, 9, and l0 of Block 4, City of Tustin, County of Orange, as per map recorded in Book 4, Page 218 of Miscellaneous Maps in the office of the County Recorder of Los Angeles County, California. Section 2- The Planning Commission of the City of Tustin duly called a public meeting on the proposed variance for September ll, 1961, at 7'30 o'clock P.M., in the Council Chambers, City Hall, Tustin, California, all in accordance with Ordinance No. 71 of the City of Tustin, as amended, and said hearing was duly held, and at said meeting no protests to the granting of the said variance were heard or received. ~ectio~ 3:. The Planning Commission of the City of Tustin further finds and determines that practical difficulties . and unnecessary hardships will result from strict compliance with Ordinance No. 71, as amended, as it relates to said property, unless the variance requested be granted; and in particular it is found and determined that there were exceptional circumstances and conditions applicable to the said property and the intended use thereo~ that do not generally apply to property or classes of use in the same zone; that such variance was necessary for the preser- vation of a substantial right of the applicanSs, in that said property could not otherwise be fully and properly utilized; and that the granting of such variance will not be detrimental to 110 the public welfare or injurious to the property or improvements in the zone or district where the property is located, due to the type of variance applied for by the applicants, as set forth in said application, to which reference is hereby made. Section 4: The variance applied for is hereby granted for the construction of a sign 5 feet by 22 feet, to extend 5 feet over the right of way of First Street, and the bottom of said sign to be not less than 20 feet above the ground as set forth in said application to which reference is hereby made. PASSED AND ADOPTED by the Planning Commission of the City of Tustin, at a regular meeting thereof held on September 11, 1961.
