A RESULTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, GRANTING A VARIANCE
UPON THE APPLICATION OF WALTER T. McCUISTION
The Planning Commission of the City of Tustin, California,
does resolve as follows'
Section ~: The Planning Commission of the City of
Tustin finds and determines that a proper application for
variance was filed by WALTER T. McCUISTION for the granting
of a variance to allow the operation of a furniture refinish-
ing business for the property described in said application,
6eing located at 158 Main Street, Tustin, California.
Section 5' The Planning Commission of the City of
Tustin, duly called a public hearing on the proposed variance
for the 14th day of November, 1960, at 7'30 P.M., in the
Council Chambers, all in accordance with Ordinance No. 71 of
the City of Tustin, as amended, and said hearing was duly
held, and at said meeting no protests to the granting of said
variance were heard or received.
Section 3' The Planning Commission of the City of Tustin
further finds and determines that practical difficulties and
unnecessary hardships will result from strict compliance
with OrdinanCe No. 71, as amended, as it relates to said
property, unless the variance requested be granted; and in
particular it is found and determined that there were ex-
ceptional circumstances and conditions applicable to the
said property and the intended use thereof that do not
generally apply to property or classes of use in the same
zone; that such variance was necessary for the preservation
of a substantial property right of the applicant, in that
said lot and property could not otherwise be fully and
properly utilized; and that the granting of such variance
will not be detrimental to the public welfare or injurious
to the property or improvements in the zone or district in
which the property is located, due to the type of variance
applied for by the applicant, as set forth in said application,
to which reference is hereby made.
Section 4: The variance applied for is hereby granted, sub-
ject to the further limitation that there shall be no work of any
kind done on Sundays.
PASSED AND ADOPTED by the Planning Commission of the City
of Tustin, at a regular meeting thereof on the 14th day of
November, 1960.
