HomeMy WebLinkAboutPC RES 531RESOLUTION NO. 531 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, GRANTING A VARIANCE ON THE PROPERTY DESCRIBED HEREIN TO NUBUO AND HELEN K. MIYAMOTO. The Planning Commission of the City of Tustin does resolve as follows: Section 1: The Planning Commission of the City of Tustin finds and determines that a proper applica- tion for variance was filed by NOBUO and HELEN K. MIYAMOTO for the purpose of using the property described in said application for a nursery; said application for variance is incorporated herein by reference as though fully set forth in this place. The Planning Commission of the City of Tustin duly called a public hearing on the proposed variance on the first day of August, 1960, at ? P. M., in the Council Chambers, all in accordance with Ordinance No. ?1 of the City of Tustin, as amended, and at said hearing no pro- tests to the granting of said variance were heard or received. Section 2: The Planning Commission of the City of Tustin further finds and determines that practical difficulties and unnecessary hardships will result from strict compliance with Ordinance No. ?1, as amended~, as it relates to said property, unless the variance requested be granted, and in particular it is found and determined that: (a) There are exceptional circumstances and conditions applicable to the said property, and the intend- ed use thereof, that do not apply generally to property or classes of use in the same zone. (b) That such variance is necessary for the preservation of a substantial property right of applicant, in that said lot cannot otherwise be properly utilized. (c) That the granting of such variance will not be materially detrimental to the public wel- fare or injurious to the property or improvements in the zone or district in which the property is located, due to the type of use intended by applicant, as set forth in the application, to which reference is hereby made. Section 3: The variance applied for concern- ing the property described in said application is hereby granted, on the following conditions: (a) That all applicable ordinances of the City of Tustin be complied with; (b) That the use of said premises be limited strictly as stated in the application, for nursery use; (c) That the proposed use be commenced with - in one year from the date of this Resolution; (d) That the applicant dedicate to the City of Tustin twenty-two (22) feet of the property facing Newport Avenue, and to effectuate such dedication that the applicant execute a Deed to the City, to be prepared by the City Attorney. Section 4: The property referred to herein- above is described as follows: LOt 13, in Block "A" Of MARTIN'S ADDITION, as recorded in Book 19, at Page 79, of Miscellaneous Records of the County of Los Angeles, State of California. PASSED aND ADOPTED by the Planning Commission of the City of Tustin, at a regular meeting thereof held on the first day of August, 1960.
