A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING A VARIANCE ON THE PROPERTY
DESCRIBED HEREIN TO GLORRIANNA F. DEAN.
The Planning Commission of the City of Tustin does
resolve as follows:
Section 1. The Planning Commission of the City of
Tustin finds and determines that a proper application for
variance was filed by Glorrianna F. Dean for the purpose of
adding an additional dwelling on the property hereinafter
described; said application for variance is incorporated
herein by reference as though fully set forth at this place.
The Planning Commission of the City of Tustin duly called a
public hearing on the proposed variance on the 13th day of
April, 1959, at 7:00 P. M. in the Council Chambers, all in
accordance with Ordinance No. 71 of the City of Tustin, as
amended, and at said hearing no protests to the granting of
said variance were heard or received.
Section 2. The Planning Commission of the City of
Tustin further finds and determines that practical difficulties
and unnecessary hardships will result from the strict com-
pliance with Ordinance No. 71, as amended, as it relates to
the hereinafter described property, unless the variance
requested be granted, and in particular it is found and
determined that:
(a) There are exceptional circumstances and conditions
applicable to the hereinafter described property and the intended
use thereof that do no apply generally to property or classes
of use in the same zone, in that the lot described hereinafter
is 150 feet in depth and several lots in the immediate vicinity,
of the same depth, have multiple dwelling units.
(b) That such variance is necessary for the
preservation of a substantial property right of the applicant,
in that the balance of said lot not presently being utilized
is of sufficient size and shape to permit the construction
of an additional dwelling unit thereon in accordance with the
plot plan submitted with the variance application of Glorrianna
F. Dean, and that with said additional dwelling unit said pro-
perty will be utilized more in conformity with neighboring
properties.
(c) That the granting of such variance will not be
materially detrimental to the public welfare or injurious to
the property or improvements in the zone or district in which
the property is located due to the type of use intended by
applicant, and set forth in her application, to which reference
is hereby made.
Section 3. The variance applied for by Glorrianna~F.
Dean, concerning the property hereinafter described, is hereby
granted on the condition that all applicable ordinana~ of the
City of Tustin be complied with and, in ~articular, on the
condition that a curb and sidewalk be constructed by applicant
along the full width and length of said lot on Third Street
and A Street, all in accordance with Ordinance No. 95..~'~of the
City of Tustin; said variance is granted on the furthers, con-
dition that the use of said premises be limited strictly as
stated in the application for variance.
Section 4. The property referred to hereinabove is
described as follows:
Lot 7, Block G, Tustin City, as shown on a map
recorded in Book 4, Pages 218 and 219, of
Miscellaneous Records of Los Angeles County,
California.
PASSED AND ADOPTED by the Planning Commission of the
City of Tustin at a regular meeting thereof held on the 13th
day of April, 1959.
