A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN GRANTING A VARIANCE ON THE PROPERTY
DESCRIBED HEREIN TO FRANCIS BROS., INC.

The Planning Commission of the City of Tusttn
does resolve as follows:
Section 1. The Planning Commission of the
City of Tustin finds and determines that a proper application for '.
variance was filed by Francis Bros., Inc. for the purpose of
using the property hereinafter described for the light assembly of
small electronic components, said application for variance is
incorporated herein by reference as though fully set forth at
this place; and the Planning Commission set a hearing on the
matter on the 24th day of March, 19~8, at 7:00 P. M. in the
Cauncil Chambers, and due notice of said hearing was given as
required in Ordinance No. 71 of the City of Tustin, and said
hearing was held on March 24, 1958, at 7:00 P. M., in the Council
Chambers, City Hall, Tustin, California.
Section 2. The Planning Commission of the City of
Tustin further finds and determines that practical difficulties
and unnecessary hardships will result from the strict compliance
with the provisions of this Ordinance as it relates to the
hereinafter described property unless a variance be granted,
and in particular it is found and determined that:
(a) There are exceptional circumstances and
conditions applicable to the hereinafter described property and
the intended use thereof that do not apply generally to property or
class of uses in the same zone, in that said property is not
well suited physically to a C-1 use, and has previously been
utilized as a non-conforming use in a manner not as desirable as
applicant's intended use.
(b) That such variance is necessary for the --
preservation of a substantial property right of the applicant,
in that said property has remained vacant ~'or a considerable
period of time due to the fact of its general unsuitability as
a C-1 use.
(c) That the granting of such variance will not be
materially detrimental to the public welfare or injurious to the
property or improvements in the zone or district in which the
property is located due to the type of use intended by applicants,
and set forth in their application, to which reference is hereby
made.
Section 3. The variance apolied for by Francis Bros.,
Inc., concerning the property hereinafter described, is hereby
granted on the condlti ~n that use be limited strictly as stated
in the application for variance, and this variance is not
transferable except upon application to, and approval by, the
Planning Commission of the City of Tusttn.
Section 4- The property referred to hereinabove is
described as follows:
That certain real property situated in the City
of Tustin, County of Orange, State of California,
with l~0 foot frontage on Main Street, and 80 feet
in depth, situated between "C" and "D" Streets,
more particularly described as follows:
Tustin City portion of Lots 10, ll and 12, Block 14.
The record owners of said property are Lawrence P.
Fricker and Suzanne M. Wricker.
PASSED AND ADOPTED by the Planning Commission of the
City of Tustin at a regular adjourned meeting held on the 24th
aay of March, 1958.
