IN THE COUNCIL CHAMBER. 7:00 p.m. CALL TO ORDER Given PLEDGE OF ALLEGIANCE All present ROLL CALL Staff present Elizabeth Binsack, Community Development Director Doug Holland, Assistant City Attorney Doug Anderson, Senior Project Manager-Transportation Minoo Ashabi, Associate Planner Eloise Harris, Recording Secretary Given PRESENTATIONS Douglass Davert- Certificate of Appreciation Gerald Takano, Consultant, TBA West, Inc.- Phase II of the Historical Resources Survey Update project Jennings Thanked Mr. Takano for the report; stated she had the agenda material sent to the Cultural Resources Advisory Commission (CRAC); thanked Sharon Jones and Carol Jordan for their assistance in this survey; and, asked if there will be a rating. Mr. Takano Stated the current A, B, C rating was based on modifications that have occurred; the goal is to make the rating clear to the public using twelve criterion items based on the National Register and set for local significance; the plan is to dove-tail with the current rating system. Jennings Noted that the rating sometimes affects what can be done to a home; and, asked if there will be addresses on the sheets included in the survey document. Asked if additions to the backs of houses make the houses less contributing. Replied significance has been defined; referred to the "period of significance"; noted the State's definition of significance within given time periods is the key; stated there is a judgment call involved in Tustin in terms of integrity; and, added that significance can be upgraded and the rating changed at a later time. Asked if other buildings may be eligible for the National Historic Register. Answered that nearly all the sites identified in Phase I qualify as locally significant; there are a few sites that qualify and are on the National Register; there may be other sites that may be significant in general which can be added; some will be removed due to loss of integrity. Asked staff if the completed survey could be added to the City's website. Answered that it could be made available. Asked if the survey covered only private properties and sites. Stated most the sites are private; there are a few institutional, non-profit sites; there may be parks or other types of landscaped areas of significance, but no decision has been made regarding those as part of this survey. Asked if the grove in Tustin Ranch dedicated to agricultural history or the hangers at MCAS-Tustin are eligible. Stated MCAS-Tustin was excluded from the survey. Stated the grove in Tustin Ranch is not historical; the trees were grafted; they began as grapefruit trees; there was no market for them; now the grove is lemon trees, and some are diseased and unproductive; the grove will Minutes - Planning Commission September 9, 2002 - Page 2 Jennings Director. Mr. Takano Hamilton Mr. Takano Hamilton Mr. Takano Kozak None be part of a larger study of that area; regarding MCAS- Tustin, all of the buildings were surveyed and considered as part of the EIS/EIR which is a separate issued to be addressed when the Specific Plan is brought to the Commission. Asked if there is an historic cedar grove. Indicated that the wind row in Cedar Grove Park is old but has not been designated; it has been identified as significant in the General Plan and, where possible, will be preserved; some of those trees are also diseased. Added the difference between this survey and the one done in 1990 includes looking at tract ranch style architecture; "preservation of the recent past" is very important to Southern California; for this survey, the Tustin area development during the early 1950s (post World War II buildings) was considered; a good candidate is the Lockwood Terrace area which is an intact subdivision from the 1950s that represents an architectural style that has typically been ignored. Asked if the survey area was only within the Tustin city limits. Answered in the affirmative. Asked if areas incorporated in the future could be included in a future surveys. Answered in the affirmative. Thanked Mr. TakanO and staff for arranging the presentation and Commissioner Jennings for suggesting the presentation; and, stated his agreement with Commissioner Denny's idea of putting the survey on the City's website. PUBLIC CONCERNS Approved CONSENT CALENDAR: · APPROVAL OF MINUTES- AUGUST 26, 2002, PLANNING COMMISSION MEETING. Motion carried 5-0. PUBLIC HEARINGS: , CONDITIONAL USE PERMIT 02-015 A REQUEST FOR AUTHORIZATION TO ESTABLISH A PRIVATE RECREATIONAL FACILI~ FOR GYMNASTICS WITHIN AN EXISTING OFFICE/VVAREHOUSE BUILDING. THIS PROJECT IS LOCATED AT 14761 BENTLEY CIRCLE IN THE PLANNED COMMUNITY INDUSTRIAL (PC-IND) ZONING DISTRICT. RECOMIMENDATION: That the Planning Commission adopt Resolution No. 3842 approving Conditional Use Permit 02- 015. The Public Hearing opened. Presented the Staff report. Added that staff is recommending approval of this project because it is a conditionally permitted and because the site and circumstances are different from an earlier application which was a multi-tenant, varied use that was not compatible with children being dropped off, picked up, or an educational-type facility; there were no specific loading areas proposed or that could be accommodated on-site; there are some concerns with this project regarding establishing more sensitive uses in the City's industrial districts; staff will be proposing an Ordinance amendment that will address these concerns. Asked if the e~erior lighting might be increased due to the plans for evening classes. Invited the applicant to come to the lectern. Indicated he will do whatever the City's Building staff recommends; and, added that most of the classes are geared for after-school hours, starting at 3:30 p.m. Minutes - Planning Commission September 9, 2002 - Page 4 Denny Mr. Watson 7:33 p.m. Hamilton Director Denny Jennings Director Kozak Mr. Watson Hamilton Kozak Anderson Kozak Asked if the proposed schedule was developed as a result of meetings with staff. Indicated the schedule is based of projections for the future. The Public Hearing closed. Asked staff if the 48-person limitation is based on the parking. Responded this number differentiates assembly versus non-assembly use; added the building and parking can accommodate more than 48 people, but staff would not recommend approval if it were an assembly use. Noted he spoke with Staff this evening regarding the issues stated by the Director above; and, stated his support of this project. Stated the site seems appropriate, because the parking lot is adequate and the loading and unloading of children looks safe; and, added she supports the application. Offered language adding subsection d. to Condition 2.1: "Consistency with the City's Security Ordinance shall be shown and installed." Asked if the applicant understood and accepted this new language. Answered in the affirmative. Stated his support for the project. Added his support; and, asked the Traffic Engineer if the traffic circulation and parking have been reviewed and approved by Public Works. Answered the parking and traffic circulation are adequate to accommodate the traffic generated from this site. Agreed with staff and the other Commissioners that this project site is substantially different from the earlier application; and, stated his support. Minutes - Planning Commission September 9, 2002 - Page 5 Denny Director Denny Mr. Watson Hamilton Mr. Watson None Director reported Asked why the time restriction was imposed for this use, Responded the hours of operation were based on the applicant's application; if the Commission wishes to eliminate this restriction, staff would propose not eliminating it completely but perhaps indicating the hours of operation may be reviewed annually or more often if deemed necessary by the Community Development Department to ensure compatibility with the site and surrounding area. Asked the applicant if the stated hours restrict the facility's ability to operate. Answered in the negative. Suggested that the "Olympic training" referred to in the application may involve longer hours. Stated that even the more advanced students must allow time for other activities and homework; these hours are more than adequate. It was moved by Jennings, seconded by Hamilton, to adopt Resolution No. 3842, as amended. Motion carried 5-0. REGULAR BUSINESS STAFF CONCERNS 3. REPORT OF ACTIONS TAKEN AT THE SEPTEMBER 3, 2002, CITY COUNCIL MEETING. The City Council approved Tentative Parcel Map 2002- 106. The Housing Element has been postponed to October 7, 2002. There will be a 75th anniversary commemoration on September 16, 2002. The Tustin Police Department is holding a prayer vigil at the police memorial at 9:30 a.m. on September 11,2002, to honor the victims of the attacks last year. Stated residents have expressed concern regarding traffic on Browning between Nisson and Walnut. Stated this concern will be referred to the Traffic Engineer for future response to the Commission. Thanked staff for the workshop; and, stated his hope there will be a joint workshop with the City Council in the future. None None Thanked staff for tonight's items, especially Christine Shingleton and Dana Ogdon for the MCAS-Tustin workshop. Thanked Eloise Harris, the Recording Secretary, for the new telephone cards and preparation of the Certificate for Doug Davert. Stated the monument sign on First Street near the 7-11 has several broken plastic panels. Noted that the idea of a portal or gateway identification for the Legacy project could be broadened to include older sections of the City and Tustin Ranch in order to unify all the areas; the MCAS-Tustin Reuse Plan might provide that opportunity. Provided material from the California Debt and Advisory Commission regarding a "Tools to Revitalize California Communities" conference on September 25, 2002, which might be helpful for MCAS-Tustin, business and job creation, affordable housing, Brownfield Sites, real estate development, and financing programs.
