HomeMy WebLinkAboutRDA MINUTES 2000 01 03 MINUTES REGULAR MEETING OF THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY CITY OF TUSTIN, CALIFORNIA JANUARY 3, 2000 CALL TO ORDER The meeting was called to order by Chair Worley at 7:52 p.m. at the Council Chamber, 300 Centennial Way, Tustin, California. ROLL CALL Members Present: Tracy Wills Worley, Chair Jeffery M. Thomas, Chair Pro Tem Mike Doyle Jim Potts Thomas R. Director, Community Development Scott Reekstin, Acting Senior Planner Valerie Crabill, Chief Deputy City Clerk Approximately 20 in the audience AUTHORIZATION TO PURCHASE AFFORDABLE HOME IN FORECLOSURE Mayor Worley requested a motion to add subject item to the agenda because immediate need for action occurred following preparation of the agenda. Lois Jeffrey, City Attorney, explained the subject property was located in Tustin Groves at 1241 Palm Court and was one of twenty-one restricted affordable units; lack of response by the mortgage holder and their refusal to negotiate prior to foreclosure or recognize the City's liens could force purchase at auction; if negotiations remained unsuccessful, purchase at auction was recommended; and the action would be taken to maintain the number of affordable housing units as called for in the City's redevelopment plan. It was moved by Potts, seconded by Doyle, to add subject item to the agenda because there was an immediate need to take action that developed after the agenda was posted. Motion carried 5-0. It was moved by Potts, seconded by Doyle, to authorize the Executive Director, or his designee, to make an offer to purchase property at 1241 Palm Court either from the current owners prior to anticipated foreclosure sale through negotiation with the current mortgage holder or to respond to the open competitive sale process subject to City Attorney approval of any and all agreements. Council/staff discussed alternatives and the City's requirements under State law to maintain a designated number of affordable housing units; these twenty-one units were approved as such under the City's redevelopment plan; unsuccessful attempts had been made to negotiate with the mortgage holder to cure the default; in the absence of other altematives, the City should exercise its opportunity to bid on the property at auction; foreclosure would not void the restrictive covenants on the property; and any costs to the City would be recovered with the property remaining a designated affordable unit. APPROVAL OF MINUTES - DECEMBER 6, 1999 REGULAR MEETING It was moved by Ports, seconded by Thomas, to approve the Redevelopment Agency Minutes of December 6, 1999. Motion carried 5-0. 2. APPROVAL OF DEMANDS It was moved by Ports, seconded by Thomas, to approve Demands' in the amount of $200,535.34. Motion carried 5-0. 380-10 CONFLICT OF INTEREST CODE - DESIGNATED POSITIONS It was moved by Ports, seconded by Thomas, to adopt the following Resolution No. RDA 00- 1 modifying the Appendix, Designated Positions, contained in the Redevelopment Agency's Conflict of Interest Code to add the position of Project Area Committee Member: RESOLUTION NO. RDA 00-1 - A RESOLUTION OF THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA, MODIFYING THE DESIGNATED POSITIONS CONTAINED IN THE CONFLICT OF INTEREST CODE Motion carried 5-0. 445-40 OTHER BUSINESS - None CLOSED SESSION - Chair Worley announced Agency members would convene in closed session pursuant to Government Code Section 54956.8 to confer with the Agency's real property negotiator regarding the following properties and property owners: 15981 S. Myrtle, Naren M. Shan; 16001 S. Myrtle, David Long; 17131 Kenyon, Bing Wong; 14701 Newport, Richard Cherney; 14711- 31 Newport, Stephen M. Perry; 14611 Newport, DeAnza Apartments (Chris Hull); 14811 Newport, Wendy Sherman; 14801 Newport, Russell L. Greengard; and 14781 Newport, Bruce W. Thompson; and instructions to the negotiator, City Manager or designee, shall concern price and terms of payment. ADJOURNMENT - Chair Worley adjourned the meeting at 7:57 p.m. The next regular meeting of the Redevelopment Agency was scheduled for Monday, January 17, 2000, at 7:00 p.m. in the Council Chamber at 300 Centennial Way.
