HomeMy WebLinkAboutRDA MINUTES 1997 07 21 MINUTES REGULAR MEETING OF THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY CITY OF TUSTIN, CALIFORNIA JULY 21, 1997 CALL TO ORDER The meeting was called to order by Chair Thomas at 8:20 p.m. at the Council Chambers, 300 Centennial Way, Tustin, California. APPROVAL OF MINUTES - JULY 7, 1997 REGULAR MEETING It was moved by Potts, seconded by Doyle, to approve the Redevelopment Agency Minutes of July 7, 1997. Motion carried 5-0. 2. APPROVAL OF DEMANDS It was moved by Potts, seconded by Doyle, to approve Demands in the amount of $33,921.88. Motion carried 5-0. 380-10 3. APPROVAL OF PLANS AND SPECIFICATION8 AND AUTHORIZATION TO ADVERTISE FOR BIDS FOR THE SYCAMORE AVENUE STORM DRAIN AND BLOCK WALL PROJECT BETWEEN NEWPORT AVENUE AND THE SR-55 FREEWAY (CIP NO. 700149 RDA) It was moved by Potts, seconded by Doyle, to adopt the following Resolution No. RDA 97-2 authorizing the City Council to approve the plans and specifications for the Sycamore Avenue Storm Drain and Block Wall Project between Newport Avenue and the SR-55 Freeway and authorizing the City Clerk to advertise this project for bids; and authorize the City Council and staff to administrate all future consultant agreements, bid documents and construction contracts. RESOLUTION NO. RDA 97-2 - A RESOLUTION OF THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE SYCAMORE AVENUE STORM DRAIN AND BLOCK WALL PROJECT BETWEEN NEWPORT AVENUE AND THE SR-55 FREEWAY, AND AUTHORIZING ADVERTISEMENT FOR BIDS (CIP NO. 700149 RDA) Motion carried 5-0. 400-45 4. AMENDMENT NO. 2 TO SHEA HOMES DISPOSITION AND DEVELOPMENT AGREEMENT Christine Shingleton, Assistant Executive Director, reported the Agency approved a Disposition and Development Agreement with Shea REDEVELOPMENT AGENCY MINUTES Page 2, 7-21-97 Homes in August 1995; 21 units were restricted to very-low, low, and moderate income units; a $10,000 second trust deed was mandatory on the moderate income units; the projected goal to sell all units by December 1997; the moderate income homes were not selling because of the mandatory second trust deed; the second trust deed was not mandated by State law; a draft alternative to the second trust deed developed by staff and Shea Homes was a 5% equity share buyout clause; and she stated that revisions made to the amendment after agenda distribution had been presented to the Agency. Agency/staff discussion followed regarding that the revisions were acceptable to Shea Homes; Shea Homes was anxious for Agency approval of the amendment; and the 5% equity share would be placed in the Housing Set-Aside Fund. It was moved by Potts, seconded by Worley, to approve Amendment No. 2 to the Disposition and Development Agreement (DDA) between the Tustin Community Redevelopment Agency and Shea Homes Limited Partnership, subject to any minor modifications made with approval of the City Attorney. Agency/staff discussion followed regarding releasing the homeowner from the existing second trust deed on the one moderate income unit sold; and six moderate income units were available. As an amended motion, it was moved by Potts, seconded by Doyle, to approve Amendment No. 2 to the Disposition and Development Agreement (DDA) between the Tustin Community Redevelopment Agency and Shea Homes Limited Partnership, subject to any minor modifications made with approval of the City Attorney; and offer a release of the $10,000 second trust deed to the one moderate income unit property owner upon property ~owner agreement of the 5% equity share buyout clause. Amended motion carried 5-0. 400-10 OTHER BUSINESS - None CLOSED SESSION Chair Thomas;announced that the Agency would convene in closed session to confer with Agency counsel about the initiation of litigation, one (1) case pursuant to Government Code Section 54956.9(c). Chair Thomas adjourned the meeting at 8:27 p.m. The next regular meeting of the Redevelopment Agency was scheduled for Monday, August 4, 1997, at 7:00 p.m. in the Council Chambers at 300 Centennial Way.
