AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA
AMENDING ORDINANCES 18 AND 84, PERTAINING TO
THE REGULATION OF BURNING.
The City Council of the City of Tustin does ordain as
follows:
Section 1. That Section 2 of Ordinance No. 18 shall
be and the same hereby is amended to read as follows:
"Section 2: It shall be unlawful for any person
firm, corporation, owner, lessee or occupant to
burn rubbish, waste paper, rags, excelsior, straw,
grass, weeds, or any other inflammable or combustible
material, within the corporate limits of the City of
Tustin, California, within a distance of fifteen feet
from any building or any combustible structure."
Section 2: Section 2.5 of Ordinance No. 18, as added
by amendment in Ordinance No. 84, shall be, and the same hereby
is amended to read as follows: ·
"Section 2.5: It shall be unlawful for any person,
firm, corporation, owner, lessee'or occupant to burn,
in an open, outdoor fire, rubbish, waste paper, rags,
excelsior, straw, grass, weeds, or any other imflam-
mable or combustible materi'al, within the corporate
limits of the City of Tustin, without having first
obtained a written fire permit from the Fire Chief
the City of Tustin, California. The Fire Chief of
the City of Tustin, California, shall grant fire per-
mits, upon written applicati6n therefor, when the
public health and safety shall not be adversely
affected, a~d when allowable under the applicable
rules and regulations of the Air Pollution Control
District of Orange County."
Section 3: That Ordinance No. 18 shall be amended by
the addition of Section 2.6 tO said Ordinance. Said Section
to be added shall read as fOllOws.:
"Section 2.6: It shall be lawful and permissible, in
a residential area designated, or hereafter designated,
in the Zoning Ordinance of the Cityof Tustin, as an
R-1 or R-2 Zone, for any person, f~m corporation,
owner, lesSeel.or occupant to burn rubbish, waste
paper, rags,~,exc'elsior, straw, grass, weeds, orI;
other inflammable or combustible material, with-
in an incinerator of .a type approved, or here-
after approved by the Fire Chief of the City
of Tustin, California, between the hours of 6 and
10 o'clock, A.M. on days when such burning is
permitted by the Orange County Air Pollution
Control District, and when public health and
safety are not adversely affected, and when such
burning does not create noxious conditions, or a
condition of public nuisance.
"It Shall, further, be lawful and permissible for
any person, firm, corporation, owner, Zessee or oc-
cupant to burn rubbish, waste paper, rags, excelsior,
straw, grass, weeds, or other inflammable or com-
bustible material, within a multiple-chamber in-
cinerator of a type approved, or hereafter approved
by the Fire Chief of the City of Tustin, CalifOrnia,
whenever such burning does not have an adverse
effect upon the ~ublic health and safety, and
when it does not create a noxious condition, or a
condition of public nuisance. Incinerator burn-
ing, other than hereinabove set forth, shall be
unlawful."
Section 4; Ordinance Number 18 and Ordinance Number
84, as herein modified, shall be and remain in full force and
effect, and all ordinances and parts of ordinances, to the ex-
tent that the same conflict herewith, are to that extent
hereby repealed.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California, held on the 1st day of May, 1961. ~~

and duly passed and adopted at a regular meeting held on
thd 1St day of May, 1961, by the following vote:
