OF THE REDEVELOPMENT AGENCY OF
THE CITY OF TUSTIN, CALIFORNIA
SEPTEMBER 6, 1988
1. CALL TO ORDER
The meeting was called to order by Chairman Hoesterey at 9:07 p.m. in
the City Council Chambers, 300 Centennial Way, Tustin, California.
2. ROLL CALL

3. APPROVAL OF MINUTES - AUGUST 15, 1988, REGULAR MEETING
It was moved by Kennedy, seconded by Edgar, to approve the minutes of
August 15, 1988. The motion carried 5-0.
,-, 4. APPROVAL OF DEMANDS IN THE AMOUNT OF $13,515.62
It was moved by Kennedy, seconded by Edgar, to approve subject demands
in the amount of $13,515.62. The motion carried 5-0. 60
5. MINUTES OF CLOSED SESSIONS
Councilman Prescott wanted to have an Ordinance for the Redevelopment
Agency on this matter.
James Rourke, City Attorney, clarified that the Redevelopmerit Agency
does not have ordinance adopting power, only resolution adopting power.
It was moved by Kennedy, seconded by Prescott, to adopt the following:
RESOLUTION NO, RDA 88-12 - A RESOLUTION OF THE COMMUNITY REDEVELOPMENT
AGENCY OF THE CITY OF TUSTIN RELATIVE TO MINUTES OF CLOSED SESSIONS OF
THE AGENCY
The motion carried 5-0. 60
6. EXCLUSIVE AGREEMENT TO NEGOTIATE WITH CHAMPION DEVELOPMENT COMPANY,
SOUTHEAST CORNER OF MAIN STREET AND NEWPORT AVENUE
It was moved by Edgar, seconded by Kennedy, to approve the Exclusive
Agreement to Negotiate with Champion Development Company.
Councilman Kelly asked if anyone from the Council had met with Champion
Development Company. The response was a unanimous no.
Councilman Prescott encouraged the Champion Development Company to work
closely with the city staff and the property owners in question to
arrive at an amenable conclusion. He did not want his "yes" vote to
mean he would vote to condemn the properties of those who did not want
to sell~

7. EXCLUSIVE AGREEMENT TO NEGOTIATE WITH CMS DEVELOPMENT, PROPERTY IN
VICINITY OF NEWPORT AVENUE AND SANTA (I-5) FREEWAY
It was moved by Edgar, seconded by Kennedy, to approve the Exclusive
Agreement to Negotiate with CMS Development Company.
Councilman Prescott stated that his comments made regarding Item No. 6
would also stand for Item No. 7.
The motion carried 5-0. 45
8. OTHER BUSINESS - None
9, CLOSED SESSION
Chairman Hoesterey announced the Redevelopmerit Agency would recess to
the following:
Closed SessiOn of the Redevelopment Agency pursuant to Government Code
Section 54956.9(a) to confer with the City Manager and City Attorney
regarding pending litigation which has been initiated formally and to
which the City is a party. The title of the litigation is Tustin
Community Redevelopmerit Agency v. Little Caesar Enterprises, et al.
Case No. 46-02-70, Orange County Superior Court.
10. ADJOURNMENT
At 9:11 p.m., it was moved by Edgar, seconded by Hoesterey, to adjourn
to the next Regular Meeting on Monday, September 19, 1988, at 7:00 p.m.
