The City Council of the City of T�,istin does ordain as follows: Section 1: That the City Council of the City of Tustin did, on the 7th day of July, 1960 receive a. written Petition asking that certain new territory descri':,ed in said. Petition be annexed to the City of Tustin. That before the filing of said Petition, the proposal for the annexation of the territory hereinafter described to the City of Tustin was submitted to the Boundary Commission of the County of Orange, State of California, and reported upon by said Boundary Commission with respect to the definite- ness and certainty of the proposed boundaries, the non-conform- ance of proposed boundaries with lines of assessment or owner- ship, the creation of islands or corridors of unincorporated territory and other similar matters.affecting the proposed boundaries. That said territory proposed to be annexed. to the City of Tustin is situated in the County of Orange, State of Californ- ia, and is contiguous to the City of Tustin, and was uninhabited territory at the time the aforesaid Petition was filed with the City Council of the City of Tustin. That said Petition contained a description of said territory in words a.nd. figures as hereinafter in this Ordinance described. that the City Council duly assembled at a regular meetinL of said Council held on the 7th day of July, 1960, did find that said Petition at the time it was filed and received was signed by the owners of not less than one- fourth of the land in the territory by area and by assessed value, as shown on the last preceding equalized assessment roll of the County of Orange, State of California, in which said. territory is situated, and that said territory did. not form a part of any municipal corporation, and did find that said territory is 'contiguous to the City of Tustin and is uninhabited territory. That on the 7th day of July, 1960, at a regular meeting of said City Council of the City of Tustin, Resolution No. 520 was duly passed and adopted specifically describing the boundaries of the -.territory so proposed to be annexed to the City of Tustin, and,designating such territory as "YORBA STREET ANNEXATION NQ. 2" to the City of Tustin, and giving notice of such annexation and. fixing the 18th day of august, 1960 at the hour of 7:30 o'clock, P. M. at the City Council Chambers in the City Hall in the City of Tustin, as the day, hour and place for hearing of wnitten protests to said annex- ation, and when and v,here any person owning real property within such territory so proposed to be annexed and having objections to the 'proposed annexation might appear before the City Council of the City of Tustin and present written objections to the !annexation of sai;d,territory to the City of Tustin, and directing the City Clerk to publish or cause to be published a'copy of said. Resolution at least twice, but not oftener than once a week, for two successive weeks prior to the date of said hearing, in a, newspaper of general circulation, printed, published and circulated in the City of Tustin, to -wit: Tustin News of Tustin, Orange County, California, and also in a newspaper of general circulation, printed, published and circulated -outside of the City of Tustin, but in the County of Orange, in which is located the territory hereinafter proposed to be annexed. to the City of Tustin, to -wit: Orange Daily News, of Orange, Orange County, California, and directing; that said. publication be completed at least twenty (20) days prior to the date of hearing hereinabove mentioned; and further directing the City Clerk of the City of Tustin to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assess- ment roll available on the date the proceedings were initiated, at the adreess shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said. City Clerk; and that in the event that land within the territory proposed to be annexed to the City of Tustin is owned by a County, that the City Clerk shall cause written notice of such proposed annexation to be mailed, to the Board of Supervisors of such County, and directing that such notices be given not less than twenty (20) days before the first public hearing on the proposed annexation. That or, the hour, day and at the place specified in said ?resolution No. 520 to -wit: On the 18th day of August, 1960, at the hour of 7:30 P. M., in the City Council Chamber in the City Hall, in the City of Tustin, California, the City Council of the City of Tustin did_ meet and assemble to hear and pass on all protests made to the rro-osed annexation, and the City Council did find that the Reso- lution fixing; the time and place of said hearing was pub- lished by the City Clerk as therein directed, and that written notice of such proposed. annexation was mailed to each person to whom land within the territory proposed to be annexed is assessed, or in which such person has any interest, by the City Clerk, as directed in said Resolution. That written protests were not made by the owner or owners of one-half of the value of the territory proposed to be annexed according to the last equalized assessment roll of the County of Orange, State of California, nor were protests made by public or private owners equal to one-half of the value of the territory proposed to be annexed as determined by the City Council. That in accordance with the ynrovisions of Ordinance No. 105 of the City of Tustin, as amended, the Planning Commission of the City of Tustin, and. the City Council, have duly held public hearings upon proper notice, as required by law, and - have received a report and recommendation from the City Engineer, and. said Planning Commission has made its recommendation concerning the zoning and building line set- back requirements for the territory designated as "Yorba Street Annexation No. 2" to the City of Tustin. Section 2: That the annexation of the territory included within the boundaries of the "Yorba. Street Annexation No. 2" to the City of Tustin, and more particularly described as follows, to -wit: Beginning at a point on the City Boundary of the City of Tustin, said point being 205 feet Easterly of, and measured at right ankles to, the t,lest line of the East half of Lot 14, Block "B" of the A. B. Chapman Tract as shown on a Map recorded in Book 102, Page 15, Miscellaneous.Maps, records of Orange County,California, said point also being forty (40) feet Northerly of, and measured at right angles to, the surveyed. center lineofSeventeenth Street; thence, Easterly, along a line parallel to and forty (40) feet Northerly of, measured at right angles to, the surveyed center line of Seventeenth Street, a, distance of 4.36.04 feet, more or less, to the Ilesterly right of way line of Yorba Street., being forty (40) feet wide; thence, Northerly, alon; said right of way line of Yorba Street, a distance of 1,313.24 feet to the.North line of Lot 141, Block "B" of said A. B. Chapman Tract; thence Easterly, along the-North line of said Lot 14, a distance of twenty (20) feet, more or less, to the Northeast corner of said Lot 14, said corner also being the southwest corner of Lot 10, Bock "B" of said A. B. Chapman Tract; thence, S..89`' 49' 08" F. a distance of 1321.66 feet, along the South line of said Lot 10, to the Southeast 'corner of said Lot 10, said corner also being the Southeast corner of Tract No. 34.65 as shown on a Map thereof, recorded in Book 120, Pages 14 and 15, Miscellaneous Maps, records of Orange County, .California; thence, N. 00 Olt 00" W. a distance of 594.37 feet, along the East line of said Tract No. Y=65, to the Northwest corner of Tract No. 1900 as shown on a. Map thereof recorded in Book 53, Pages 15 and 16, Miscellaneous Maps, records of Orange County, California; thence, N. 890 53' 30" W. a distance of 0.75 feet, along the east line of said Tract No. 3465, to the Southwest corner of Tract No. 2708, as shown on a Map thereof recorded in Book 90 Page 25, Mispellaneous Maps, records of Orange County, thence, N. Q o4' 30" 11. a distance of 383.14 feet, along the East line of said Tract No. 34.65, to the North6est corner of said. A. B. Chapman Tract; thence, Southerly, a distance of 1384.62 feet, more or less, along the !.lest line of said. Lot 14 and the Southerly prolongation thereof, to a point on the City Boundary of the City of Santa Ana, said point being 52 feet Southerly of, and measured at right angles to, the surveyed center line of Seventeenth Street; thence, Easterly a distance of 321.04 feet, more or less, along.said City C. Boundary of the City of Santa. Ana, parallel to. and 52 feet Southerly of, measured ured at right angles to, the surveyed center line,of Seventeenth Street, to a point on the East line of the Felipe Yorba Tract, said point also being on. the City Boundary of the City of Tustin, as recorded in the Yorba Street Annexation to the City of Tustin, thence Northerly_ Easterly, Northerly, Easterly and, South- erly, along said City Boundary of the City of Tustin, .to the point of ,beginning. is hereby approved'and said territory is hereby annexed to and incorporated in the City of Tustin, County of Orange, State of California, and is hereby designated as the Yorba,Street Annexation No. 2, to the City of Tustin. Section 3: That from and after the effective date of this Ordinance and the filing of a certified copy thereof with the Secretary of Sate of the State of California, the annexation of the territory herein described shall be deemed. to be and shall be complete and thenceforth such -;.nnexed territory shall be, to all intents and purposes, a part of the City of Tustin, and. from and after the effective date of such annexation, all property therein shall be subject to taxation equally with the ,)roperty -within the City of Tustin and shall be taxed to pay its proportionate share of the existing indebtedness and liability of said City of Tustin contracted prior to or existing at the time of such annexa- tion pursuant to the written consent of the owners of property in said annexed. territory filed with the Clerk of the City of Tustin prior to the adoption of this Ordinance. Section 4: The zones defined by Ordinance No. 71 of the City of Tustin, as amended, and the boundaries of said zones and the building set back lines, within the territory known as "Yorba Street Annexation No. 211 to the City of Tustin, are as part shown on the Map attached hereto, marked Exhibit "All plates 21 and 22, and made a part of this Ordinance, being designated. as the "District Zoning and Building Line Map for Yorba Street Annexation No. 2 to the City of Tustin"; and said Map, and all the notations, references and other information sho-vrn thereon shall be a part of this Ordinance as if the•.•Ra.tters and information set forth on said Map wpre fully described herein.
