STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 12 -79 TO ACCEPT IMPROVEMENTS FOR THE TUSTIN RANCH ROAD PHASE 1 GRADING & STORM DRAIN PROJECT CIP 70100 & 70206 AND AUTHORIZE THE CITY ENGINEER TO FILE A NOTICE OF COMPLETION SUMMARY Construction of the Tustin Ranch Road Phase 1 Grading & Storm Drain Project CIP 70100 & 70206 has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council and the Successor Agency to the Tustin Community Redevelopment Agency take the following actions: 1. Adopt Resolution No. 12 -79 accepting the construction of the Tustin Ranch Road Phase 1 Grading & Storm Drain Project CIP 70100 & 70206; and 2. Authorize the City Engineer to execute and file the Notice of Completion with the Orange County Recorder's Office. FISCAL IMPACT The final construction cost for the Tustin Ranch Road Phase 1 Grading & Storm Drain Project CIP 70100 & 70206 is $15,676,040, including authorized contract change orders in the amount of $3,052,252 or 24.2 %. The project was completed within the approved Fiscal Year 2011 -2012 and 2012 -2013 Capital Improvement Program Budgets and was primarily funded through a combination of sources that included MCAS Tustin 2010 Bond Proceeds, The Irvine Company — Developer Contribution, Measure M — GMA 7, and Community Facility District (CFD) -06 -01 Construction funds. DISCUSSION On August 2, 2011, the City Council and the former Tustin Community Redevelopment Agency awarded the construction contract for the Tustin Ranch Road Phase 1 Grading and Storm Drain Project from Walnut Avenue to Warner Avenue. The construction effort for the entire Tustin Ranch Road Extension project between Walnut Avenue on the north and Warner Avenue on the south had been segregated into two phases to permit settlement to occur during fill placement and grading of the northerly overcrossing ramp prior to other street improvements and bridge construction. This phasing of work also allowed the allocation of dewatering costs associated with storm drain installation versus those future costs associated with sewer and water line installation which will be an IRWD reimbursable expense. A Notice to Proceed was issued August 29, 2011 for the Phase 1 work, consisting of clearing and grubbing, mass grading, structural retaining wall, and storm drain /retention basin construction. Resolution No. 12 -79 S-ICity Council Items12012 Council Items\NOC TRR Phase 1 Grading & Storm Drain Project (CIP 70100 & 70206).docx RESOLUTION NO. 12 -79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AND THE SUCCESSOR AGENCY TO THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE TUSTIN RANCH ROAD PHASE 1 GRADING & STORM DRAIN PROJECT BETWEEN WALNUT AVENUE AND WARNER AVENUE CIP NO. 70100 & 70206 WHEREAS, Sandoval Pipeline Engineering, Inc., having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin and Successor Agency; and WHEREAS, the City Council and the Successor Agency finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin and the Successor Agency to the Tustin Community Redevelopment Agency that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Tustin Ranch Road Phase 1 Grading & Storm Drain Project between Walnut Avenue and Warner Avenue CIP No. 70100 & 70206 BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law. PASSED AND ADOPTED at a regular joint meeting of the City Council of the City of Tustin and the Successor Agency to the Tustin Community Redevelopment Agency held on the 18th day of September 2012.
